SM Entertainment revealed on the 23rd via TVXQ’s homepage, “2011, TVXQ will be returning to you all.”

SM released a statement saying,

“After the 3 TVXQ members left, for over a long year, both U-Know Yunho and Max Changmin have refrained from musical activities.

The two members as well as the company wanted to keep TVXQ alive, thinking about the never changing hearts of our loyal fans who have waited a long time.

As indicated by the ruling, all of TVXQ’s activities need to be done through SM, unfortunately, the three members that left have regretfully not responded to any of our offers for activities as TVXQ. After long and careful consideration, we made this decision.

For U-know Yunho and Max Changmin, who never left and kept their dreams as TVXQ, we have decided together with the two members to keep TVXQ alive.

No matter what happens, we believe that TVXQ should continue for the love and trust of the fans who created TVXQ together with us.

We are not ruling out any possibilities in the future. Continuing TVXQ is the best way to repay the fans who love and waited for TVXQ.”

The two member TVXQ is scheduled to make a comeback in January 2011.

I haven't posted in a while lately, there's just been too much depression in the fandom. But I saw this article recently over at DBSKnights. Just thought I'd share it with my fellow Cassiopeians.

911 is over, SMTown is over. Listening to the screams of desperation on the audio stream had so many of us crying rivers. This explosion of emotion is the result of a year's worth of waiting...

Yes, because they're TVXQ, they are our TVXQ, whether it be 2 or 3, we'll accept them all the same. As long as you're good and well, as long as you're able to stand on that stage, even if there's only one of you, we'll love you all the same, because it is Jung Yunho, Shim Changmin, Kim Jaejoong, Park Yoochun and Kim Junsu that we love, but above all, it's TVXQ.

Watching rookies appear one after another in Korea, watching their popularity rise and yours drop has made no difference to us. We cannot and will not forget. [Trans] 100103 TVXQ Japan Contract will Expire in June…

AVEX official gave an official stand related to the chaotic/confusion among TVXQ fans both in Korea and Japan which has been happening after the article about TVXQ already stepped on disbanding procedure was released by Japanese newspapers.

On the 3rd, Nikkan Sports Japan quoted Japanese official from AVEX company, “The policy of TVXQ to work as five members doesn’t yet to change.”

However, as been informed, TVXQ contract with their Japan company AVEX will expire in June. If the contract is not extended from now on, whether TVXQ can continue activities in Japan, it won’t be yet secured.

Currently TVXQ Changmin and Yunho still remain under SM Entertainment while the rest members Jaejoong, Yoochun, and Junsu have left expanding their each individual activities.

Just sometime ago, in Japan TVXQ attended NHK’s year-end award festival Kouhaku Uta Gassen as five members for the first time, however the three members, whose provisional disposition application to terminate exclusive contract against SM Entertainment was accepted by the Korea court as the issue of court injunction, seem to be more passionate in the performance and there was an unseen tense and emotional conflict with the remaining two members that makes the current situation is impossible to predict.

The problem now is whether SM will extend the contract of the 3 members with AVEX after June. The fact that currently TVXQ is at their peak of popularity in Japan is something that can not be ignored under any condition especially in relation to revenue circumstances.

TVXQ is now in a situation of an attempt to reach into final decision amicably to be able to work together in a long-term in Japan.

[Lawsuit] 091031 TVXQ Dispute 'SM's Dilemma'

Much attention has been put on SM Entertainment and its future actions as the Courts have sided with the three TVXQ members YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu on the legal dispute between the three and their agency regarding their exclusive contract.

On the 27th, the Seoul District Courts partially accepted the exclusive contract suspension request against SM Entertainment submitted by Xiah Junsu, YoungWoong Jaejoong and Micky Yoochun.

To have the Courts partially accept the exclusive contract suspension request is to have the Courts decided that the contract between SM and the members of TVXQ is in fact unlawful. According to the decision of the Courts, SM is not allowed to interfere or question any individual activities of the three members or create contracts regarding group activities without the consent of the three members.

For now, SM has stated that the agency cannot accept the Courts' ruling. SM Entertainment released a notice stating "Although the entire contract was not suspended, the Courts stated that some parts of the contract was questionable and that is why we are submitting an appeal," and "Till now, we have kept some information from the media as the Courts requested that neither side be interacting with the press during the trial. Now we will reveal that information and release an official statement.

Unless an extremely controversial secret is revealed by SM Entertainment that could turn the tables, it can be said that the contract between SM and TVXQ has already been nullified.

The dilemma that SM faces now is the fact that the agency's other singers may attempt to leave the agency in the same method. TVXQ is not the only reason why SM is being so adamant and firm of their stance in this dispute. To state that conclusion first, there is close to no chance of TVXQ disbanding or ending their activities. This is because all three members involved in this dispute have no thoughts of leaving the group names TVXQ. Some representatives to the entertainment business stated that, "There is a high chance that SM and the three members will become equal partners regarding activities such as the release of a new album in the future."

The problem is how the two sides will fix the contract and the income division. Although the income SM receives from album sales or commercial activities will reduce, it is not so much that the company will run into bankruptcy.

The biggest problem for SM Entertainment is the fact that the majority of agencies works under a system that invests money to raise trainees into singers in a span of 1~7 years that does not guarantee profit after the singer's debut. In the case of TVXQ, if they are allowed to leave the agency stating that the contract was unlawful after gaining popularity, the agencies will have no incentive to continue on with this method of raising stars. This is also why the Fair Trade Committee constantly fails to come to a consensus with agencies when it comes to creating a basis contract.

The reason that SM is being carefully watched for its future actions regarding this trial and the consequences that follow is because this is not merely a problem between SM and TVXQ.

First of all, the Courts have sided with the three TVXQ members. In reference to the exclusive contract suspension request submitted by Xiah Junsu, YoungWoong Jaejoong and Micky Yoochun, the Courts laid down the decision that 'SM Entertainment is not allowed to interfere or question any individual activities of the three members or create contracts regarding group activities without the consent of the three members.'

This dispute between the group that is the Hallyu Wave's key player and king of the Asian market and the group's agency, the nation's top entertainment agency, is said to bring large waves of change not only to the entertainment industry, but to the entire nation as well. Many have said that the Courts' ruling has kick started the battle against unlawful contracts while others have said that the decision has completely ignored the trainee-raising method of most entertainment agencies.

The TVXQ case can be seen as a result of SM's 'Failure At Management.' However, that is only the evaluation based on the results. The reason the TVXQ dispute has come so far and deep is because there was a charge forward with a lack of 'communication and respect' on both sides.

One of the reasons that this dispute cant not be the center of attention in the entertainment industry is because the Courts have sided with the members of TVXQ and completely overturned the traditional method of agencies' formation of their contracts. We cannot blatantly say that all 13 year contracts are slave contract. As long as 'communication and respect' is prevalent and a fair income division is put in place, it will be a happy contract. They would be willing to sign onto a contract longer than 13 years at will. They would not think of moving to a different entertainment agency.

If TVXQ's birth is inspected, the process is a system with no room for 'communication and respect.' TVXQ is a team that was created by picking the best out of hundreds of trainees and forming a group. Even the members themselves would not have known what lay ahead of them in the future of their music careers. They were able to snag the title of 'Top of the Korean Music Industry' under the system of a large entertainment agency, and their entrance into the overseas market was probably calculated meticulously. The entire process would amount to a total of 10 years.

As this much time has passed, the members are bound to have looked back on themselves. They are also bound to have increased their musical control and bettered their abilities to select their paths. There were times when they had to stand on a stage regardless of the fact that they did not want to, and they would have had to handle the agency's actions to stop any activities that may 'endanger the group' with a feeling of oppression. This is where 'communication and respect' is needed. As the two sides are the bests of the best, there probably was the need to approach the situation calmly and after much thought. If things have come so far, there were bound to have been instances unknown to the public that pushed it so far. To become irreparable.

In truth, the members are preparing to 'sue for the nullification of the contract and compensation for damages incurred from the income division' while SM is submitting an appeal. SM has also stated that they will be revealing information that has not been told before and releasing an official statement.

When seeing all the big and small disputes that have erupted in the Korean music industry, they all originate from income division problems (unlawful contracts), failure to communicate (respect for human rights), natural limits (musical limits, lack of responsibility as a celebrity), and a interference of the family (interference from a third party).

But the income division problems have been the biggest disputes in this industry. Income division is important to gain trust and investments. If income division is not transparent, that is what a slave contract is. The lack of transparency in income division is what started the lack of human rights for celebrities in the music industry in the mid 90s.

The music industry must use this dispute as a stepping stone towards a change in 'communication and respect'. What can gain more trust than a contract is'communication and respect' and 'a transparent income division'. There is no other 'road to a solution'.

On the 27th, the Seoul District Courts sided with popular group TVXQ's three members and their exclusive contract suspension against SM Entertainment. The Courts decided that the entertainment agency was not allowed to create new contracts without the consent of the celebrity and must not interfere with said celebrity's independent activities in the business. Therefore, a road of free movement has opened up for the members of TVXQ. Although the formal trial procedures are left, this decision seems to shed light on the future of unlawful contracts that are rampant in the entertainment business. Overall, the call for shift from a vertical relationship to a parallel, equal relationship is welcomed. Many expect this dispute to lead into an equal relationship between celebrities and agencies in the future.

Till now, the Korean entertainment business, as the term 'slave contract' implies, has been criticized for its inability to escape unlawfulness and unfairness. The majority of celebrities was put at a disadvantage starting from when their contracts were set up and have become mere tools of agencies. From their official activities to personal actions, everything celebrities did was dictated by their agencies. This was the kind of situation that the three members of the nation's best idol group were in when they went against their agency. If they were in such a state, it is not hard to think of what unthinkable states the no-name celebrities and not-so-famous celebrities are in.

Most domestic entertainment agencies work under a scout-train-management system. Agencies have trained talented rookies and raised the value of no-name celebrities in this organized and investing method. However, although it is easy for a celebrity to become wound up in an unlawful exclusive contract, it is not as easy to escape from his or her entrapment. It can be said that the Courts ruled that, "This is an unfair structure that does not give the members even the bare minimum rights they should have," and "As the members have to pay extremely large amounts of compensation if they go against the contract, it is impossible for the members to wander astray from the contract," because of such methods employed by entertainment agencies.

This decision will bring about a big change to the entertainment business as a whole. This is because the complaints that have been silenced till now may erupt and flood. There is a high chance that the dispute between the members of TVXQ and their agency will take a long time. Right after the Courts' decision, the three members stated that they would file lawsuits for Compensation for Damages and Exclusive Contract Nullification, while the agency has stated that they will be revealing information that the Courts requested they keep quiet from the media and an official statement. This reporter hopes that this dispute will not end a mere expendable argument, but a stepping stone to a new cultural change in the entertainment industry. The tyrannical domination of the biased and vertical patriarchal culture that believes that, "Since I have raised them, I can do whatever I want with them," must now come to an end. It is time that a win-win and equal relationship was created in our entertainment business to take the industry to a whole new level.

[Lawsuit] 091029 SM-TVXQ Contract w/r/t/ Income Distribution

The Court has granted the injunction filed by the members of TVXQ against SM Entertainment.The Court found that the Contract between SM and the Members was unconscionable and against public policy. Following this victory, the Members are proceeding with the main suit to ask for the rightful shares of all income generated from their activities.

The following is a summary of the outrageous terms of the Contract that relates to the distribution of income. The clear conclusion is that the TVXQ members have received next to nothing for their six years of work, and that virtually all money we spend to buy SM products stay with SM. Please read the below to see the extent of the injustice.

Please keep in mind that SM's contract with TVXQ has been amended five times and therefore the applicable terms have varied over time. Accounting for all the resulting complexities, the truth adds up to the following:

I. TVXQ has received $0 for their album sales prior to July 2008, and only a negligible amount after that date.

Prior to the fifth and final round of amendments on July 1, 2008, the Contract read that for any album or single with sales not exceeding 500,000 copies, SM would be entitled to 100% of the profits, leaving the members with nothing. From the time of TVXQ's debut in late 2003 and until TVXQ's release of their 4th Korean album "Mirotic" in September 2008, no Korean album had sold more than 500,000 copies. Therefore, prior to July 2008 TVXQ has had absolutely zero income from their album sales.

On July 1,2008, SM amended the Contract to give each Member 1% of total sales for each album that sells over 200,000 copies. For any albums that sell fewer copies, the members are to receive 0.6% to 0%. SM has not honored even these outrageous terms, as it has not paid TVXQ a single cent since February 2009.

In sum, SM has kept 100% of all sales that TVXQ has generated with the sales of their albums and singles prior to July 2008, and has kept 95% or more of the sales after that date.

II. TVXQ has received $0 for the sales of concert DVDs and albums featuring recordings from such concerts.

Under the Contract, the Members are not entitled to receive any share of the profits generated from sales of concert DVDs and "live" albums.

III. TVXQ has received $0 for their appearances on TV programs.

Under the Contract, Members are not entitled to receive any share of the profits made through their TV appearances if the appearance is of a temporary nature. As all programs on which TVXQ appeared have featured the Members as "guests"and therefore by nature have been temporary, SM has kept all profits that TVXQ has generated from these TV appearances.

IV. For all other possible sources of revenue, SM subtracts from the total revenue all expenses, including salaries of other staff, stage preparation expenses, rent, travel expenses, food expenses, and the like, then gives TVXQ only a fraction of the remaining amount.

As for all other sources of income, the Contract states that TVXQ is entitled to varying percentages of the "net income." The Contract defines "net income" to be the amount remaining after the applicable "operating costs". The "operating costs" are defined to include such expenses that are traditionally expected to be covered by the employer, including but not limited to 1) salaries of the staff (manager, clothing coordinators, makeup artists, dance crew, and the like), 2) performing stage preparation costs, 3) living expenses, including rent and water/electricity bills, 4) travel expenses, including plane ticket costs, 5) meal expenses, and the like.

Even after all these "operating costs" are deducted from the net income, the Members are only entitled to a small percentage of the remainder while SM keeps the rest.

In conclusion, please realize that SM has kept virtually all of the profits that our Members have generated over the past six years. Our Members have received, literally, next to nothing.

Following thevictory of the granting of the preliminary injunction, the Members now prepare for a suit to claim their rightful share of the profits that they themselves generated.

The Korean Idol World Realities

“I fell through the cracks,” said the attractive brunette sitting across from me with her characteristic bluntness.

I first met Isak (real name: Ida Simmons) when I worked at Arirang TV and Radio, an English-language broadcasting station. The daughter of a Caucasian father and a Korean mother, Isak had previously been the member of an unsuccessful SM Entertainment act called Isak N Jiyeon. However, she managed to eventually parlay her bubbly charms into a successful career as both a DJ and VJ at Arirang Radio.

While Isak, who still has three years left on a ten-year contract, applauded SM founder Lee Soo Man’s ability to think outside of the box and accept a biracial Korean-American into his company, she also remembered the more suffocating aspects of being a K-pop entertainer in the earlier part of the decade. For example, when she lived with several other SM trainees in a dormitory-like setting, the girls’ managers devised a clever way to keep tabs on the talent:

“[T]hey were afraid that we would sneak out. They would put in a house phone for us, and we couldn’t call from our cell phones. We had to call from our house phone to our manager as soon as we walk[ed] in the door [to inform them] that we came in.”

Isak also recalled the strict no-dating policy at the time:

“No dating,” she said. “You get caught, you pay consequences.”

I asked her what the consequences were.

“I was threatened that if I didn’t break up with my boyfriend then I would be either cut from SM or not [be] able to debut.”

Ironically, Isak found that the no-dating rule could actually hamper an artist’s performance, especially since many K-pop songs were about the very topic that its singers were forbidden to engage in: love.

“They’re singing about love but they’ve never experienced love,” she complained. “I think that’s a very big error.”

Isak noted, nonetheless, that a lot had changed in the industry. While “just look pretty and dance” may have been the rule when she began her career, current K-pop fans expect a lot more personality from their favorite stars. Now, as Isak noted, “it seem[s] to be becoming a trend for celebrities to be dating in Korea… a lot of people were coming forward and being honest about their relationships.” And it didn’t stop there: entertainers like Lee Hyori would even appear on reality shows, doing things like going to doctor appointments sans makeup, allowing fans to become even closer to their idols.

The trend toward a more naturalistic and approachable depiction of idol stars, according to Isak, is a positive one, and she heaped a great deal of praise on 2NE1, a four-member girl group represented by YG Entertainment:

“I don’t think 2NE1 is the typical Korean pretty girl,” said Isak. “I think they’re the most beautiful girls in the world because they don’t have double eyelids; because they don’t have noses that hit the ceiling; because they don’t have that “entertainer” look that people have grown accustomed to.”

For all the positive changes that have happened in the industry, however, Isak had a warning for those who were dreaming of becoming an idol star: long contracts and hidden fees had not disappeared.

“They [the management companies] promise before you debut, ‘we’re going to house you, we’re going to feed you, we’re going to give you all the lessons you need. Do your best’ and then we think that that’s all free,” remembered Isak. She soon learned, however, that all the expenses that went into her upkeep, including stylists, salon visits, manager fees, food, and clothing, were deducted from her pay.

Young Kim, host of the Arirang Radio program “K-pop Zone” and former rapper for such groups as S#arp and Uptown in the late 1990s, noted just how little money one could make, even as a member of relatively successful groups: “I made about three thousand dollars in the seven months that I was promoting the [S#arp] album.”

Although Kim, Isak, and others I spoke with said that they believed conditions had greatly improved, recent legal battles and contract disputes (such as the one staged by three members of the immensely popular boy band TVXQ against SM Entertainment, their management company) suggest that something may be rotten in the candy factory. As one industry outsider told me with a knowing smile, “They work their kids hard.”

However, Mark Russell, a Korean pop culture expert, recently commented on his blog, the problem is actually not rooted in the management companies, but rather in the Korean music system itself. Having to train, house, and feed future stars whose success will ultimately have to recoup not only the investment in them, but the company’s investment in other trainees who have yet to make it or who simply fell through the cracks…the economic constraints of such a system are considerable, to say the least. Imagine, then, the costs that go into sustaining the thirteen members of Super Junior or the nine young ladies who make up Girls’ Generation.

More revealing was when Russell told me that, “[In] the late 90s, Koreans spent, depending on the exchange rate, somewhere in the neighborhood of four to five hundred million dollars a year on CDs and tapes. Last year, they spent 60 million. We’re talking about an 80% decline.” The steep fall in music sales could explain why over the years, K-pop stars have moved from being only singers to multitasking entertainers – unless you were writing your own music (and many idol stars do not), there just wasn’t that much money to be found in music anymore. Revenue would have to be generated through concerts, commercial shoots, and public television appearances. Meanwhile, selling talent overseas was no longer just a ploy by the bigger management companies to increase profits, but a financial necessity as the Korean music market continued to shrink.

There are big risks at stake for those investing in idol groups. These risks did not go unnoticed by Isak who understood her previous lack of freedom, stating that, “[We] are products. I know it sounds very bad, but we are products, and that’s why our companies…sometimes treat us like products.”

However, for all the financial risks the companies bear, perhaps the biggest gambles are still those taken by the talent in sacrificing their youth to achieve national or even international stardom. As D-Lite (Daesung Kang) of Big Bang put it, sacrificing “common things in life that we liked – walking around the streets, time to hang out with old friends, etc…” was something he knew he’d have to do.

Every idol star has gone into the K-pop game knowing the cost of fame. Behind the bright lights and their big smiles hides another truth, which D-Lite voiced in simple terms: “We all knew that we had to let it [their former lives] go when we decided to [join] Big Bang but, honestly, sometimes it’s tough on me.”

As I pondered the pressures of surviving in a shrinking Korean music market, I could only think, “It’s tough all around, kid.”

[Lawsuit] TVXQ talks with SM Entertainment break down

TVXQ / DBSK / Tohoshinki members Xiah, Micky, and Jaejoong were trying to make efforts to resolve the issues with SM Entertainment behind the scenes but it seems all talks of coming to an agreement have broken apart. Korean Media Outlet Newsen recently had a phone conversation with the court overseeing the issue.

In the phone conversation, the court stated that it'll be all up to them to come up with the resolution as both sides despite talks of resolution, will not budge from their initial stances. They continued by stating that they're thoroughly reviewing all the papers, documents, and evidence given. After this thorough investigation, both parties will be notified of the decision. The Court stated that they don't know when exactly they'll come up with the decision but that it should be sometime this month.

As the talks have broken down, it seems there's no chance of resolution outside the courts. Hopefully the courts come up with a fair and firm decision.

[Lawsuit] TVXQ vs. SM Entertainment Pending Final Decision - All Evidence Due Today

The legal battle regarding unfair contracts between team TVXQ (Youngwoong Jaejoong, Micky Yoochun, Xiah Junsu) vs. SM Entertainment is slowly coming to an end.

The court had ordered SM Entertainment to turn in all financial documents by September 11th, 2009 (today in Korea). Upon review of these documents, a final decision is to be made.

The court has stated that this will be a final judgment and that both parties will not be returning for a retrial, once a decision is made.

[Lawsuit] 090831 TVXQ's Japanese Income Division; Each Member Received "150 million Won"

An argument that five member group TVXQ, who are currently in a legal dispute with their agency over their exclusive contract and inexact income divisions, earns an extremely low income from their Japanese activities has been put forth.

An influential acquaintance of the three members who are locked in this legal dispute (YoungWoong Jaejoong, Micky Yoochun, Xiah Junsu) stated, "The amount of money TVXQ has earned from when they started their Japanese activities in 2005 till now is a little over 150 million Won per member."

This is the first time TVXQ's Japanese activity income division has been referred to in detail.

He explained the income division process in detail saying, "A portion of the money TVXQ earns from their Japanese activities goes to their Japanese agency Avex, and some of it goes to SM Japan. The rest goes to SM Entertainment. Therefore, the members receive only an extremely small portion of the overall income."

He also added, "SM Entertainment owns more than 90% of SM Japan's quota and is the parent company of SM Japan," and conspired that, "Another controversy arises of their Japanese income division because of this." He stated that, "Since the members have never seen the actual Japanese contract, they have no clue of how the income division is going on between the agencies and are feeling very frustrated with the situation."

SM Entertainment owns 93.5% of SM Japan's quota

Actually, according to the quarterly report SM released in May, SM Entertainment owns 93.5% of SM Japan's quota (On March 31st).

Even the Civil Society Organization has pointed out that there are problems in the way SM Entertainment divides and calculates the income.

Lee Dong-yeon, professor at the Korean National University of Arts, stated, "The money TVXQ earns from their Japanese activities is first divided by Avex and SM Japan who co-manage the group by 50% each, then SM and SM Japan split the money SM Japan got by 50% each. Therefore, TVXQ only receives a small portion of 1/4 of their income, not a portion of their entire income".

At the debate that was on the prompt 'The Problems Regarding the Korean Entertainment Management System Revealed Through the TVXQ Dispute and the Solutions To These Problems', Professor Lee said, "It can be said that SM Japan and SM Entertainment are basically one company therefore SM Entertainment is using this to acquire twice the amount of money they should be getting from TVXQ's Japanese income."

Professor Lee also stated that, "It can easily be seen that we obviously cannot say that TVXQ and SM Entertainment have a fair and just contract agreement when carefully reading through the fine print of the contract and taking into consideration TVXQ's income division and the preposterous amount SME claims they spend on managing TVXQ (In truth, most of this money is actually not included in the income division.)"

On a side note, it has been found that SME did not adhere to the Preservation of Evidence Request that the three TVXQ members filed that was accepted by the Courts. This Preservation of Evidence Request includes all documents relevant to TVXQ's activities that would help calculate TVXQ's actual income that include account books, receipts, transfer slips, etc.

On the 21st, the Seoul District Courts asked SME at the first hearing to hand in all documents relevant to the trial, but SME did not follow through.

SME's lawyer stated before that, "These documents are all company secrets, and it would be fatal to SME if they were released to the media."

[Lawsuit] DBSK`s Activities in Japan is About 1.5 Billion

In regards to the long term contract and undisclosed earning percentage split problem, it had created an unfair contract. Tohoshinki’s 3 members finally decided to go through court to resolve this dispute with their agency SM Entertainment.

Recently, the 3 members of Tohoshinki had requested to have their earning percentage split in Japan’s documents without taking in much consideration.

It is said that Tohoshinki had debuted in Japan in 2005 and till now, 4 years had passed and each member's earning in these 4 years could only reach about 1.5 billion. This is the first time that Tohoshinki’s earnings from their daily activities in Japan have been revealed.

Representatives had too expressed that SM JAPAN is a company that SM KOREA has 90% control over, and because of the matter over in SM Korea, it is said that it makes one suspricious of how SM Korea manages to pay for SM Japan too.

The members are rather confused over the whole percentage split earning because they have yet to see the whole real contract, according to SM in May revealed their financial status, SM Japan belongs around 93.5% to them. In regard to this matter, the public have raised questions.

Korean art schools professor, Lee Dong Ting said “Because of Tohoshinki’s activities in Japan, it had created a problem in percentage splitting. According to Tohoshinki’s agency, SM Japan and Avex would like to take in 50-50 of the earnings then between SM & SM Japan, another 50-50 in earning’s and in truth, Tohoshinki actually received only 1/4 of the earnings during these activities.

With an agenda of “Through Tohoshinki you could see that the companies system is full of problems and solutions were made,” Professor Lee also pointed out “SM JAPAN and SM been seen as 1 company is okay, therefore this kind of split for earning’s can bee seen as a dirty hand trick.” Professor Lee then said “The total amount that Tohoshinki is getting, being an artist and enjoying their reputation along with SM’s way of making use of the money in the name of ‘because it’s business’ (IE. Saying they need to pay their stylists etc) is not tallying with the reality calculation.”

There was an offering of a sacrific to the spirits done for MBC’s new Wednesday-Thursday drama ‘Heading to the Ground.’

On the 24th at 2pm, the offering was one at MBC’s Yangju set and actors such as Jung Yunho, Ara, Lee Yunji, Lee Sang-yoon, Kim Jaeseung etc camealong with Director Park Sungsoo and all the staff.

Fans from all over Korea, who may have had ill feelings towards the long stretch of Japanese activities, act as though the group had never left and stare at their TV and even go up to the TV screen and stroke it. I’m talking about the comeback stage of that happened after the album’s release last December. Fans found something a little odd about TVXQ during this stage. Although the five members’ faces were the same, it was as though their faces had been stuck on someone else’s body. This was because of their ‘muscles’.

TVXQ’s thin and muscular bodies are completely different from SM Entertainment’s preceding idol groups. The direction that the members of TVXQ are headed is being influenced by the Japanese activities they have been carefully and diligently doing. In Japan these days, their is a ‘Hosomacho’ or ‘thin muscle’ trend blazing through the nation. The biggest reason for this trend is because the majority of young Japanese women prefers the thin muscled hosomacho look over the heavily muscled gorimacho (gorilla macho) look.

What am I talking about? There are probably going to be some people who tell me that this trend has been around for a while with the majority of singers in Johnny’s Entertainment and with the majority of males in Tokyo having a thin muscle body structure. But what they are talking more about skinny guys who look as though they have muscles because they are skinny, not the ‘thin muscle’ look. But to think that TVXQ is just one of the many hosomacho groups is a big mistake. This is because the popularity of Tohoshinki, as they call themselves in Japan, is so great and out of this world that it cannot be fully comprehended or understood in Korea.

If we divide the dominating Japanese male idol groups into three categories, the first would be ‘role Lolita’, groups comprised of pretty boys, the second would be ‘Yankees’, groups comprised of members who have a bad boy vibe to them, and the third would be the TVXQ style. The TVXQ style’s popularity can be properly felt in Japan’s host clubs. Koreans may connect the words host or hostess with adult clubs and see these words with a negative outlook, but to many young, handsome and popular college students in Japan, it is the most preferred part-time job.

Different from Korea’s hosts, Japan’s hosts serve only alcohol and there is a different term for those who provide sexual intercourse and they are called ‘Urisen’. In these host clubs that can easily be found in Shinjuku’s Gabukicho area, the pictures of the hosts in the clubs tell women what kind of style each host is. Before, most of the people in the pictures copied the style of Johnny’s Entertainment’s idol groups. But now, at least one or two hosts in every club very conspicuously copies the style of one of the members of TVXQ.

In this area, there was once a time where the most manly people were nabe (a girl dressed up as a guy or a trans gender female). with their thin, pretty bodies. But now many Japanese women are asking for the hosomacho style, men who are not only pretty, but are also manly, and who are not only skinny, but has muscles. The TVXQ wind is blowing through the clubs of Gabukicho.

Since many Korean idol groups are popular not only in Korea but all of Asia, many Koreans may think that TVXQ’s popularity is similar to that of other celebrities. Shall we delve deeper to see just how popular TVXQ is in Japan? TVXQ’s most recent Japanese single sold almost 200K copies in one week. This sets TVXQ with the second highest first week sales in their agency, Japan’s biggest company Avex.

The only group above TVXQ is the 14-member group Exile, the group that received the highest award from the Japanese Record Association and the group that even creates big changes in society with their raging popularity. This means that TVXQ’s first album sales beats that of the female leaders of Japanese pop, ‘Amuro Namie’. ‘Hamasaki Ayumi’ and ‘Koda Kumi’. This is a feat that not even popular star ‘BoA’ has achieved. These are the kind of top singers we can compare TVXQ to now.

But I am not basing their popularity on album sales only. TVXQ has set a huge record of being on Japan’s representative music chart ‘Oricon Chart’ as 1st on weekly single sales six times already. Since the year 2000, the number of stars who have attempted to enter the Japanese market is enormous, with stars such as S.E.S, Sugar, Park Junghyun, Rain, Lee Soo Young, Se7en, SS501, Ryu Siwon, Park Yongha, Lee Byunghun, Yoonha, K, Sunmin, Big Bang and Super Junior.

But the only singers who have reached first on Oricon’s weekly single charts are BoA (once) and TVXQ (six times). TVXQ also succeeded in being invited to hold two concerts in July at the Tokyo Dome which is considered the Dream Stage, even to Japanese singers. This has never been completed by any other Korean singer before.

But the Bible sends a message, “Prophets do not get respect from their homelands.” For some odd reason, TVXQ’s outstanding achievements do not seem to be reported or praised in Korea. Also, it is sad to see that TVXQ’s success of almost selling 200K copies of their single was buried under the dispute between SM Entertainment and three members of TVXQ (Micky Yoochun, Xiah Junsu, YoungWoong Jaejoong) and the disbandment rumors that followed it.

They are not something something ’sama’ (like Yonsama) who were washed ashore by the Hallyu Wave. No, they even asked all Japanese media agencies not to associate the word ‘Hallyu’ with them (even asking for news articles to be pulled down if the word was used in relation to them), to show that they wished to succeed with their own powers and were able to become widely known in Japan. TVXQ had to erase their nationality in order to gain the acceptance from the Japanese population.

The rumors of disbandment at the height of their popularity has become a hot topic of conversation in the Japanese music industry. Japanese media has been created a daily special to update everyone about what’s happening in Korea with regards to TVXQ, and this has caused Avex’s CEO to come forward and give an explanatory statement to clam the Japanese fans. He announced that TVXQ’s Japanese activitees would continue regardless of what was happening in Korea and he decided to announce this himself. This has never happened before.

It seems as though the way Korean agencies set the income division when writing up the contract has surprised the people of Japan who are used to the Japanese agencies’ way of working that gives monthly salaries that may change. Since the first official event TVXQ held after the disbandment rumors came out was in Japan and not Korea, the source of such rumors, with the Fireworks Festival Concert, the Japanese media was more vigilant when it came to reporting the issue than the Korean media.

Therefore, whether they wanted this or not, this case has opened TVXQ up to a wider fan base including the younger generation. YoungWoong Jaejoong, who is the most popular amongst the members in Japan, was even seen in a paparazzi scandal magazine that only extremely famous Japanese celebrities appear in.

Although the situation in Korea is a complete mess, TVXQ might be able to take one step further in their Japanese activities through this happening. But they must once more grab hold of their Korean fans. There are already rumors that the ‘light fanbase’ is ready to embrace the new 6 member male idol group SM Entertainment is preparing.

As faithful as Korean fans are, they are also able to turn their backs on a singer very quickly. If even the fans who used to embrace them turn their backs on TVXQ, the group will become the prophets who are not respected in their homelands.

Seoul’s Gangnam Police Station on August 27th has lauched a full investigation regarding lawsuit filed by cosmetic company, CREBEAU in which DBSK members Jaejoong, Yoochun, and Junsu have their investment.

The public prosecutor from Seoul police office section 7 (head: Kim Cheong-hyeon) directed the investigation according to letter of complaint to SM Entertainment from CREBAU officer who requested for a full investigation of complainant’s identity before court review next week.

This police investigation is held as an instant basis to decide whether there’s criminality charges in defamation mark that is accused to SM Entertainment as defendant by CREBEAU company.

Seoul Central District Court officer revealed on August 26th that a representative of CREBEAU (위샵플러스) cosmetic company had filed lawsuit against SM Entertainment in charge of defamation issue on August 4th.

CREBEAU representative said, “The problem that is filed by 3 members who are also investors in our company is something to do with the unfair distribution income and to terminate the exclusive contract effect. [Lawsuit] SM x DBSK Lawsuit: “Will The Evidences Application be Accepted?”

As had been reported, besides the provisional disposition to terminate exclusive contract effect, 3 members of DBSK namely Jaejoong, Yoochun, and Junsu also submitted Preservation of Evidence request so that they could calculate the exact amount of their income.

However, in the first hearing held on last August 21st, SM responded regarding the Preservation of Evidence request, “This immediate appeal for Preservation of Evidence can’t be executed.” SM expressed disapproval regarding the submission request. The company explained that DBSK income receipts along with other documents and materials needed for this settlement is company’s trade secret. And if they’re to be exposed to the media, it can lead to fatal effect.

Regarding the problem, the court described an “in camera” system to invalidate SM’s claim of a fatal risk. The “in camera” system is the process in which the viewers of the evidences are to selected/limited number of people only. Because of this, DBSK’s payment issue can be resolved and the current conflict can be raised.

SM officials therefore approved the DBSK’s ‘Preservation of Evidences application’ and the submission deadline is tomorrow, August 26th.

The court judgment whether SM’s application is received as valid evidences or not is to be determined on Friday, August 28th.

Meanwhile, on the same day (August 28th), DBSK fanclub Cassiopeia is showing support to their idol by submitting petition which is signed by approximately 121,073 people at 1:30 p.m to National Human Rights Commission. “DBSK members have been victims of serious human rights violation and now are seeking way to escape from it. We asked the help from National Human Rights Commission to give human rights protection for DBSK members through their court hearing.”

On last August 20th, Cassiopeia had already submitted their petition which was already signed on-line by 120,000 people from August 12th to 18th (six days) to Seoul Central District Court to support the terminate of unfair contract.

SM Entertainment (SME) stated that they were the only ones who received damages because of the request for the suspension of TVXQ's exclusive contract.

On the 21st at 10:20 am, the first hearing for the lawsuit between SM Entertainment and the three members of TVXQ's Youngwoong Jaejoon, Micky Yoochun and Xiah Junsu, began.

During this hearing, SME's lawyer stated, "In the case of the three members of TVXQ, they don't have any dissatisfied feelings towards this lawsuit as it got them out of concerts and advertisements that they did not want to participate in," and "But in the case of SME, they had to pay compensation for said canceled events and future scheduled events with 8 billion Won to pay domestically and 15 billion Won to pay if overseas activities are calculated. Not only will SME suffer monetary loss, the image of SME has also been hit because of this trial."

SME's lawyer stated that the focus of this lawsuit was not the period of the exclusive contract or the unfair income division, but the cosmetic company that the three members were involved with. He explained that the only two reasons SME asked the three members not to participate in such a venture were because such a venture went against their exclusive contract and because the venture could hit TVXQ's image in a negative way.

SME's lawyer also said, "In reference to the length of their exclusive contract, the special quality of the entertainment business needs to be considered," and "Even in the recommended exclusive contract guidelines released recently, there are exceptions when it comes to singers."

He also said, "The three members claim that they never were told of exactly how much they earned but SME revealed this amount to the members every six months and the members even signed these income documents."

On a side note, the three members of TVXQ filed for an Exclusive Contract Validity Suspension and Provisional Disposition Request against their agency SM Entertainment on July 31st. They also filed for a Preservation of Evidence request to be able to calculate the exact amount of TVXQ's income.

The three members asked for a cancellation of their contract due to the unlawful clauses in said contract but SM Entertainment stated that the three members were filing this lawsuit because of the cosmetic company they were associated with; both sides show no signs of backing down. TVXQ's leader U-Know Yunho and youngest leader Choikang Changmin did not participate in this lawsuit.

[Lawsuit] TVXQ's 1st Court Hearing Ended Today

TVXQ and SM Entertainment's first court hearing took place today August 21st, 2009 at 11:40am KST.

TVXQ's lawyer stated "TVXQ members are very upset about the entire situation, but hopes that the lawsuit will end well." In addition, "We do not want TVXQ to split up. And even if they do change management companies, there is still a chance that TVXQ will remain together."

SM Entertainment's lawyer stated, "There are no personal grudges against the members, however this lawsuit is an enormous loss to the company, therefore we wish to resolve this as quickly as possible and have TVXQ continue their activities." In addition, SME stated that, "In regards to the members running Chinese based cosmetics businesses, SM only intervened as it could potentially hurt their image. That was the only reason."

The 1 hour and 20 minute hearing over exclusive contract rights and improper compensation is now over, however all parties are required to submit all proof and documentation by September 12th, 2009, in order for the courts to make a final judgment.

TVXQ: " We Want This Lawsuit to be Finished as Quickly as Possible"

TVXQ's YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu have stated that they wish for their lawsuit against SM Entertainment to finish quickly.

Both sides stated their position at the first hearing held on the 21st at 10:20 am.

The members' side pointed out the unlawful problems in their exclusive contract as well as the doubtful income division made by SME.

SME's side stated that they were in red figures for four years after TVXQ debuted, said that they had divided the income well and that what the three members were saying was false.

Both sides stated that they wanted this lawsuit to be solved as quickly as possible. The judge stated, "If both side would like to set a settlement date that will not be open to the public, that can be arranged," and urged both sides to come to a mutual agreement.

It can be seen that the judge believes it will be better for the two sides to start fresh as quickly as possible rather than have a tiring fight in court.

On the other hand, on the 20th, 120,000 fans submitted petitions against SME's unlawful contract to the Seoul District Courts where the trial is being held.

They also filed for a Preservation of Evidence request so that they could calculate the exact amount of their income. TVXQ's leader U-Know Yunho and youngest member Choikang Changmin did not participate in this lawsuit.

DBSK forced to a corner; freedom comes at a price of 10.6 billion TWD

Unsatisfied with their treatment under their managing company, members of Korean superstar boyband Dong Bang Shin Ki, namely Xiah Junsu, Youngwoong Jaejoong and Micky Yoochun have brought their case to court.

However, once the hearing is held and if the members lose their case, a compensation sum of approximately 10.6 billion TWD will have to be paid, tantamount to forcing them into a tight corner.

At the beginning of this month, news of the three members being dissatisfied with SM Entertainment and wanting to leave had begun to surface. In return, SM declared publicly that there was no such thing, and even professed that if they wanted to leave, then they would have to pay to do so.

Once the news of this got out, the 800 thousand strong fan base of Dong Bang Shin Ki almost immediately took action, firstly by using the cancellation of the SM Town Concert to start a boycott of SM products as a form of support for their idols.

SM Entertainment has also seemingly not cared much about all of these measures fans have been taking. Instead, SM has been registering the names of their popular groups such as Super Junior and So Nyeo Shi Dae (Girls’ Generation) as well as Dong Bang Shin Ki, in order to prevent Dong Bang Shin Ki from starting over elsewhere.

According to news reports, a seminar where media experts and scholars came together to discuss this problem all stood on DBSK’s side, saying that SM has used DBSK merely for profit, and the amount that they are paid every year, five miliion TWD, is ridiculous.

Now that DBSK wants their freedom back, the price that they have to pay is far too much, and purely a device to back them into a corner that they cannot retreat out of.

The “Dong Bang Shin Ki Seminar”, co-held by fans, scholars and media experts, was held in order to examine what would happen in the case if the three members lost the case: the end result would be to pay the 10.6 billion TWD compensation sum.

Thus, fans have denounced SM as a bloodsucking company, and they wish to voice out for their idols via the SM boycott

MBC's 'Section TV Entertainment News' is receiving scorn from TVXQ fans.
On the latest episode aired on the 14th, 'Section TV Entertainment News' attempted to interview the TVXQ members who are in a conflict with their agency SME and in return, received a lot of criticism.

Agency SM Entertainment who has been having legal disputes with 3 members of TVXQ, on July 4th submitted trademark application of names of some of its singers including TVXQ, Girls’ Generation, and Super Junior. SM is currently waiting for the result.

In 2004 SM already tried to enter the same application but was rejected since “There’s no agreement from TVXQ members,”. To consider the current situation where there’s disputes between the two sides, the members are most likely not consent yet, again.

Meanwhile, quoting the statement from patent attorney Hwang Sung-pil which was aired on MBC “Happy Day” on August 17th, “The cycle of legislation from trademark rights to trademark, is to legitimate the brand of artists name when deciding margin products, as well as to identify the source of right to display certain brand so that customers are ensure of one’s brand reliability.”

Estimation of the value of star name.

The star name whose value is worth for 180 billion won, is gained by Seo Tai-ji on 1st rank. The Korean wave star Bae Yong Joon name is worth for 100 billion won, and rose the 2nd.

Active in three countries including Korea, Japan, and U.S, singer BoA is ranked 3rd for 100 billion won while on 4th with estimation value of 50 billion won is name of group Shinhwa.

DBSK Fancafe’s Prosecution Application Demanding Compensation

On last August 14th, DBSK fancafe submitted a prosecution application to Korea Consumer Protection Board with subject ‘The postpone of SMTOWN LIVE ‘09′.

The fancafe explained their background of accusation, “They acted unilaterally in postponing the concert, without consideration and fooling all the consumers who had already bought the concert tickets. Thus, we submitted this application.”

In the statement which DBSK fancafe submitted to Korea Consumer Protection Board, they mentioned, “SMTOWN LIVE ‘09 which is scheduled to be held on August 16th is indefinitely postponed.

The postpone was announced a week ago (August 7th) with the reason that DBSK’s case status will make the whole SM family couldn’t unite in the concert.

However, on August 14th when SM released SMTOWN Summer album ‘09, they promoted the song by stressing it as ‘a song which shows friendship among the young men‘ which shows a whole contradictory.”

DBSK fancafe demanded not only full refund of their tickets, but also 10% admission fee as compensation and official apology from SM Entertainment.

On July 31st, three members of TVXQ, Xiah Junsu, YoungWoong Jaejoong and Micky Yoochun, filed for an Exclusive Contract Validity Suspension and Provisional Disposition Request Form, and the Seoul Central District Court has accepted the three members' Preservation of Evidence Request.

The Seoul Central District Court has accepted the three members' Preservation of Evidence Request that they submitted on the 5th earlier this month through the Sejong Law Firm. This request was for the preservation of all receipts, transaction slips, account books and such to calculate the exact amount of TVXQ's income.

It has been found that the Court demanded that SM hand in all documents relevant to this lawsuit.

[Lawsuit] Is There a Solution for ‘Slave Contracts?’

With Korean pop group TVXQ embroiled in legal action against its agency, SM Entertainment, over an allegedly unfair contract, fans and agencies alike are focusing attention on the validity of so-called “slave contracts.” Contracts are dubbed as such for reported disadvantaging the stars and would-be stars who enter into them with management agencies.

These excessively binding contracts came into focus when actress Jang Ja-yeon ended her life earlier this year amid allegations that she was threatened and forced to provide sexual favors by her former agent.

TVXQ brought yet another perspective to ongoing speculations regarding unfair practices carried out by both large- and mid-sized entertainment agencies here.

According to the legal document filed by three members of the group ― Micky, Xiah and Hero ― the agency prohibited their freedom as artists by claiming that the group’s and members’ activities belonged to the agency, requiring them to follow the agency’s demands to appear at certain performances and broadcasts, and requiring them to stay under the agency’s wing for 13 years.

Experts say that this type of contract is standard in Korea’s entertainment industry. A newcomer’s path to stardom depends highly on local agencies’ investments, unlike in the United States, where up-and-coming artists often sign deals with agencies after proving their talents at bars and small theaters on their own.

“From top stars like the late actress Choi Jin-shil and singer Uhm Jung-hwa, celebrities were ‘made’ into stars by their agents and agencies. These young artists need to be ‘invested in’ for at least 10 years,” said Choi Jung-han, a lawyer and former head of the Korea Entertainment Law Society.

The agencies, naturally, extend contracts for more than 10 years to collect investments in the future. Of course, this only applies to successful cases.

Choi explained that although agencies spend their time and money investing in several groups and aspiring talents, only a few of those clients ever taste success. This leads to contracts that trap successful stars into what is now referred to a “slave contract.”

“If the case with TVXQ and SM does not settle down in a proper way, the same incidents will continue again and again. We must revise contract terms regarding the contract periods and profit distribution,” Kim Won-chan, chairman of the Korea Singers Association, said during a radio interview last week.

Kim pointed out that although SM Entertainment claimed that they offered 11 billion won to the members, the fairness of the payment amount should be questioned, considering the overall profit the agency has received over the past years.
“There must be separate regulations detailing the maximum and minimum amounts in profit distribution,” he said.

The Fair Trade Commission posted a recommendation notice regarding the issue last month, setting forth a standard contract for artists and agencies.

“The commission did release the notice as a standard contract, but this does not have any legal effect, which is why many agencies and artists are quarreling about the actual practice of it,” culture critic Kim Sung-soo said.

Kim added that the overall atmosphere must change to scrap such “slave contracts” and messy legal disputes.

“This type of discontent appears because Korea focuses on only a number of stars. Agencies have no choice but to rely on those who are popular and successful. In the case of major entertainment agencies, newcomers have no choice to follow their contracts to become famous. We have to change the overall system so that the entertainment business can focus on a larger and longer perspective and nourish various types of artists,” he said.

Meanwhile, the group is expected to follow through with their scheduled performances in Japan. Avex, the group’s agency in Japan, said last week on its official Web site, “We will support TVXQ’s Japan activities to the full. We expect fans to continue to root for TVXQ,” according to Yonhap News.

“We have received assurances that both sides don’t want the group to disband. This is interpreted as meaning that SM and the three TVXQ members will go ahead with their scheduled performances in Japan,” Avex said.

The K-pop group will sing in Tokyo on Aug. 22 and 23 and Osaka on Aug. 29 and 30.

The five-member boy band will also appear on “Music Japan,” NHK’s music program* next month.

SM Entertainment has once again applied for the trademark rights for Dong Bang Shin Ki.

It is known that SM Entertainment had gone to apply for continuation of trademark rights for the name ‘Dong Bang Shin Ki’ at the Korea Industrial Property Rights Information Service (KIPRIS) on 5th August together with 3 other names.

Currently the company is in a lawsuit with Dong Bang Shin Ki 3 members Xiah JunSu, Micky YooChun and Hero JaeJoong, and this application has brought up different interpretations from music experts.

With the case of SM Entertainment applying for trademark rights for the name, especially since there was once in 2004 SM has refused to do so for 東方神起, much interests are roused as to the intention behind the act.

SM Entertainment also applied for trademark rights of other groups like Super Junior and So Nyeo Shi Dae on 4th August.

One music industry expert said, “Applying for the trademark rights for the singers in your own company is a natural thing. Sometimes it has been taken as a sensitive issue by many.”

Another said, “The company has the right and this is a natural thing to do. It shouldn’t be seen as a bad intention.” While another said, “Dong Bang Shin Ki is a group that is wellknown throughout Asia and Korea. If the trademark rights are abused, it is damaging to their image. There was a problem of disbanding some time back. But it is true that the sensitive time comes when the company applies for trademark rights to the name.”

[Lawsuit] Probe Finds Entertainers Frequently in Bum Deals

After three of the five members of the Korean pop band Dong Bang Shin Gi, a k a TVXQ, took legal action against the group’s management agency, S.M. Entertainment, on July 31, claiming an unfair contract, officials began examining how other top groups are being managed.

What they’ve found was sometimes startling. Yuna, a member of a band called Girls’ Generation that is under the same agency, is in a 13-year contract similar to the ones claimed by the three TVXQ complainants.

A member of Super Junior, a 13-member pop band managed by S.M., cannot leave the company for between five and 13 years.

“Even though I want to transfer to another management agency, it is not easy because of the long contract period and a large penalty I would have to pay,” the member said during a phone interview with the daily newspaper Ilgan Sports. “Since each member receives 1/13 of total profit earned from the band’s record sales, individual income is not that high.”

Members of the Wonder Girls, a five-member girl band under JYP Entertainment, have signed an exclusive 7-year contract.

Members of pop groups Big Bang and SS501 are locked into 5-year contracts by YG Entertainment and DSP Entertainment, respectively.

During its investigation into 20 management companies starting in April, the Fair Trade Commission has found unfair contract clauses for 230 entertainers managed by 19 agencies.

Included in such clauses are ones mandating that entertainers have to report their whereabouts to the manager at all times, contractors are not allowed to get any job in the entertainment industry after terminating contracts and contractors cannot retire without authorization from the manager.

Following the investigation, large agencies have completed either renewing or revising contracts and small and medium companies are in the process of doing so. So far, most legal disputes have been between agencies and actors and actresses rather than singers. “The reason why controversies over unfair contracts among singers have not surfaced is that within Korean pop music, there still exists a custom of running the business by verbal agreement rather than strict contract clauses,” said an executive official from an agency who asked not to be named. “Many new singers think that it is hard to become a star if they file complaints against their companies. I believe there are a lot of entertainers suffering from unfair contracts.”

The official also said that members of idol pop bands are mostly teenagers when they sign contracts and have to serve two to three year apprenticeships. They have no choice but to accept unfair contracts because they will not have a chance to debut if they fail to satisfy managers during their training period.

Many experts say disputes between agencies and entertainers occur because agencies try to make up for initial investment costs they expend in promoting idol groups. Also, some budding stars fail to make it despite the investment, leaving the agencies holding the bag. Agencies complained that it is difficult to run the company when contracts are revised after an entertainer becomes popular because of various investment costs.

Others see things differently. “If Korean management agencies keep on taking the lion’s share of profits earned by their entertainers, more legal disputes like TVXQ are bound to happen,” said Lim Jin-mo, a music critic.

Experts say the only way to limit onerous contracts is to adopt new rules and regulations. Along with these steps, some suggest that the patriarchal system that lets agencies treat their entertainers as chattel needs to be modernized.

As conflicts related to unfair contracts have flared in recent years, the Fair Trade Commission began a contract-by-contract probe into the issue and has requested revisions. Some improvements have been enacted. And the commission introduced a system of using “standard contracts” for entertainers last month and strongly recommended that the entertainment industry to use it.

However, there are exceptions in the revised contracts letting an agency sign long-term contracts for special reasons, such as a long period of overseas activity. Korea Entertainment Producers’ Association has come out against the new system, saying that it does not reflect the reality of Korean pop music.

Perhaps the Achilles’ heel of the proposed contract is that it is merely a recommendation that has no enforcement teeth. Japanese fans of TVXQ and many experts there deride Korean entertainment management. They said it is impossible to sign a contract that lasts for more than 10 years in Japan.

But there are differences in the entertainment culture of the two countries. In Japan, where the scale the entertainment industry is much larger than in Korea, a few big agencies are firmly in control of the industry. New entertainers renew their contracts every two or three years and get paid monthly. In the United States, one entertainer is sometimes managed by two separate companies, a management agency which supports overall activities, and an agent overseeing an entertainer’s products and contracts.

“The entertainment industries in the United States and Japan have developed after going through a lot of trial and error. It is impossible and not right for Korea to immediately follow their example,” said Hong Sung-kee, president of Korea Entertainment Law Society.

Some say culture is more important than changes in written rules and laws. In a culture that refers to an agency as an entertainer’s benefactor while treating a singer as a betrayer when he or she complains, it is difficult to develop a reasonable contract. “Even though more Korean entertainers are becoming popular on the global stage, the system of managing them has not changed,” said Lee Dong-yeon, professor of Korean Traditional Arts at Korea National University of Arts.

“A new management system and culture have to be developed so that new entertainers can also get legal advice when signing contracts,” he said.

Singer/actress Eugene talks about her views regard the discord between SM Entertainment and Dong Bang Shin Ki. She said in a recent interview, “Even though I don’t know the details, I hope both sides can settle this amiably.”

Eugene was from S.E.S under SM Entertainment debuting in 1997. S.E.S was one of the first girlgroups and had the concept of fairies and had made issues with their songs and costumes. After which, there were the other girlgroups like Fin.K.L, Baby VOX, Chakra. And then recently we have WonderGirls and So Nyeo Shi Dae etc.

Eugene said, “It is true that SM have a good training system for a big company. With that, there are many youths who wants to debut under these big companies and there are many cases of them signing long term exclusive contracts with the company. When the singers grow and develop, the contract should also change if not there will be piled-up unhappiness. It is a shame that companies take advantages of the weaknesses of these new singers.”

She added, “Recently when I look at the juniors, it seems that their schedule is so tight they can hardly breathe. It would be great if they are able to find happiness and influence through their entertainer activitise and at the same time are able to improve on things like profits etc.”

'Visual Shock', pretty boy YoungWoong Jaejoong who has looks that seemed to pop out of a comic book, manly leader U-Know Yunho, sweet guy Micky Yoochun with soft features who shows his honest feelings by frequently crying on stage, tall and handsome Choikang Changmin who is the youngest and cute Xiah Junsu who talks and acts like a child. These characters can be seen anywhere from tv shows to performances, to even the smallest of actions. It is almost as if they have made a kind of drama about themselves unlike other groups.

'Xiahmori', known by the vast majority of fans, is the members' intentional bullying of Xiah Junsu. Not only does this bullying emphasize Xiah Junsu's cute factor, it also shows the closeness of the members. To compare, the members of TVXQ are like the members of 'Infinite Challenge', each having their own unique character and part, each member created their own story of their characters early on in their singing career. Their images grew stronger as they matured. Masculine U-Know Yunho's 'oldest brother' image sunk in and stayed. While Yoochun's warm acceptance of Xiah Junsu's childish behavior has given them a 'sweet couple' image. The team's youngest member Choikang Changmin, who had the weakest image at the start, became the cool, indifferent 'Chic Chang,' or the 'Real Leader.'

These images and characters were the deciding factor when it came to the fans' acceptance of TVXQ's existence as one story. There are endless 'activities' to do with TVXQ as the subject. Fan-Fictions that include the idol members loving each other are prevalent in other groups, but they are not as good quality or quantity wise as they are with TVXQ as the main subjects. There is also a game that is called 'TVXQ's Answers for Situations'. It is a game where fans imagine what members would say about a same situation. Through these games, fans are able to become closer to the members, and the relationship between fans become stronger as they share games and laugh about their content. Not only their official fan club site 'Cassiopeia', but also all their tens and hundreds of fan cafes and sites have become a playground for fans.

The world's greatest fanclub that got on the Guiness Book of World Records

The number of people in Cassiopeia is 800,000. The number of people in Daum's fan cafe 'Yuaerubi' is also 800,000. SM stopped signing Cassiopeia members in 2006. Nowadays, TVXQ's fans Cassiopeia are simply called 'Ca-A' or 'Kang'. Cassiopeia, a name that derives from the five star constellation, was included in the Guiness Book of World Records for the largest fan club in the world. TVXQ's fandom, that started off as most fandoms do with the majority of fans being in their teens or 20s, spread out to include people in their 30s and 40s, and international fans. The fan clubs have even divided based on age. 'Xiah Soul' is a fan site for people in their 30s who have a preference for Xiah Junsu, and 'DongnaeBangnae' is a fan page where many international fans participate.

The fandom's personality has changed as well. The generation of fans who not only worship their idols, but also protect and support them, or act as spokespeople for the stars has come. The motherly guardian fandom that watches the stars grow from a young age started off with 'the first Nation's Idol' GOD and has evolved and solidified with TVXQ. The fandom that considers themselves the spokespeople of the stars have served community service hours or donated money under the name of the star. 'Match Made in Heaven' and 'AVC' are some of the Cassiopeia community service groups that move around the nation helping others. Fans do these services to better their star's image but they also become great contributors to society. As many people know, when the Mad Cow Disease crisis occurred in Korea last year, the first people to protest on the streets were the fanclubs of TVXQ.

The Internet's groups for people with the same taste

A fanclub's strongest cohesion comes from liking the same thing. Especially for society's underdogs who are open to the economic aspect of life, teenage girls, it is hard to find the sharing of one's affection without any competitiveness. The only competition amongst fans happens to be their faithfulness of their stars. In fan sites that work on a ranking system, many ask detailed questions about TVXQ for 'level ups'. There are even essay questions such as, 'The effect of a capella on TVXQ.'

The made-up language and ceremonies that only the fans know have also solidified this fandom. Cassiopeia decides on the type of cheer they will use at a TVXQ concert through voting. There are thousands of words and phrases that only the fans understand. The word 'Ilko' refers to an adult who hides the fact that he/she is a TVXQ fan and acts like a regular person. But the biggest influence of the fandom can be found in the music market. Instead of downloading illegally, fans have opened up their wallets for CDs even if TVXQ releases three versions of the same album. At the same time, TVXQ has also become a victim of an excessive fandom. Because of them, the new 'personal life fan (A fan who follows them everywhere)' has emerged who follows the star's movements almost 24 hours every day.

'Fan-Fic', putting sexual imagination to paper

TVXQ is also at the top when it comes to Fan-Fiction, a characteristic of idol fandoms. Fan-fics refer to the romance novels written by fans that depict the idol stars engaging in homosexual relationships. Rather than going against their 소유욕 by having their 'oppas (older brothers)' taken by other girls, the fans have made the members gay in the stories. It can be seen as a branch off of Japan's 'Yaoi' culture. After TVXQ's debut, SM aroused the homosexual imagination aspect by linking the members as couples. Of course this does not mean that the members are actually gay, and they used this romantic imagination, that could be used for heterosexual situations, to relieve the built-up sexual tension that women in their teens and 20s have. Many of the fan-fic writers are up to par skill-wise to professional writers. The majority are free to read through the writer's homepage, but there are some that are sold for profit.

An interesting fact is that there has been a sudden surge of fans in their 30s and 40s. This correlates to the increase of Auntie-Uncle fans that have appeared in society these days. They act as a protective guardian fandom as well as a fandom that has physical desires for people who are extremely younger than those fans are. Like adults who love teen romance such as 'Boys Over Flowers' or "Gossip Girls', they have an air of people who are physically attracted to and wanting idols who are way younger.

The Idealization of 'Me'

As most teens are limited from relationships because of their age, idols become a 'substitute lover' for them. At the same time, fans see idols as a part of themselves, feeling the success of the idols is their own success. Also, since teens live in a highly competitive society and do not have many successes of their own, they see TVXQ's success story with great awe (This is also why fans can be ruthless when it comes to tight competition with other groups.) If the members of TVXQ are not able to overcome this current situation, the devastating impact it will have on their fans is unimaginable.

They even have unwavering Vocal Abilities

The most important point of this TVXQ syndrome is their music. Even though they debuted as an idol group, they showed their vocal maturity and growth through their Japanese activities. Match the powerful dance skills trained through the SMP genre (SM's unique genre of song with powerful dancing), their stage presence, their ability to sing unwaveringly even after a powerful dance, and their good looks, and it's no wonder TVXQ started off the second Hallyu Wave. From dance to pop-ballads, the members have done them all and have used the members' star-qualities to their fullest potential. At live concerts, especially, has their music touched many hearts and that is why they are worthy of being called 'The Gods of the East' by their fans all over the world.

[Lawsuit] 090809 TVXQ’s Homepage Flooded With Complaints

After the ‘SM TWON LIVE ‘09′ was postponed indefinitely by SM Entertainment who said the reason was the lawsuit between the agency and TVXQ’s three members, Xiah Junsu, Micky Yoochun and YoungWoong Jaejoong, the fans’ criticisim has been flooding in.

SM released an official statement on the 7th of Augus stating that, “The ‘SM TOWN LIVE ‘09′ that was scheduled to be held on August 16th at the Seoul Jamsil Olympic Stadium has been postponed indefinitely.”

SM also stated that all ticket holders would be receiving a full refund but the fans’ rage did not subside easily. On TVXQ’s Hompage, posts of disappointment came from not only TVXQ fans, but from fans of other singers who were to be performing in the SM TOWN concert.

TVXQ fans stated, “We put a lot of effort and money into making events, and now they’ve become obsolete,” “How are they going to compensate for our efforts to secure tickets?” “We even rented a car to go, how are going to compensate for that?” “We’ve waited one year, and this is what we get?” They showed such strong reactions and protested to SM Entertainment. Some fans said that SM was trying to place the blame on TVXQ by saying that the concert was postponed because of the group and harshly criticized SM for what they did.

The fans of fellow SM Entertainment singers such as SHINee and Super Junior also showed their discontent and sided with and supported the fans of TVXQ.

Some fans said they would visit SM to give their complaints while other said they would boycott SM goods. There has also been a suggestion for all the fans to gather and rally against SM on the 16th at the Jamsil Olympic Stadium at the time the concert was supposed to happen.

SM said, “SM TOWN LIVE ‘09 was a concert that was extremely popular with tickets being sold out as soon as they were put on sale, so we are very sorry to be giving out this unfortunate news,” and “We promise to bring a better SM TOWN LIVE concert in the future to those fans and families who wish to come to these concerts.”

TVXQ participated in the Meiji Jingu Fireworks Summer Event held in Tokyo, Shinjuku. The staff working at the event covered the passage that lead the members to the stage with black material so the members would not feel disorientated by the fireworks.

Due to the lawsuit from TVXQ, SM Entertainment (SM)’s SMTOWN LIVE’09 Concert was postponed.

On August 7th, SM representative said, “SMTOWN LIVE’09 which will be held August 16 at the Seoul Jamsil Olympic Stadium will be temporarily postponed,” he said.

With three members of TVXQ are involved in injunction application against SM, it’s impossible to hold a normal concert–as judged by SM–therefore the concert is temporarily postponed.

SMTOWN LIVE’09 main point is a major concert that features harmonization of various stage from all SM families, and the current situation is not applicable to do so. Thus for the sake of quality performance, the decision was made.

SM Entertainment revealed recently, “We split profits with group Dong Bang Shin Ki at the ratio of 4:6.”

Our Tohoshinki members, JEJUNG, YUCHON, and JUNSU have been confronting with SM Entertainment Co.Ltd (headquarters: Seoul, Korea), to apply provisional disposition to stop the exclusive contract effect to Korean court. Regarding this matter, the members have said, “This is a temporary injunction application, do not make any assumptions that TVXQ will be disbanded.”

In return, SM Entertainment Co.Ltd also stated, “TVXQ is not a thing such as individual or an enterprise, it’s a group that represents the country as well as Asia. We think TVXQ’s activities should continue.”

From each side statement, it’s clear that both parties do not desire for the disbandment of TVXQ.

[Lawsuit] Park Chan Jong: "SM, fraud against DBSK."

Note: This is from the experience and perspective of a respected lawyer OUTSIDE the lawsuit, meaning, he is not involved in the case himself but is giving his opinion on the matter.

Park Chang Jong lawyer, former member of the National Assembly, who previously dealt with big cases such as ‘Minerva’ and Park Yeon Cha case revealed his stance on the controversial DBSK Case. He is the representative of ‘Honest People’ and in a report stated that, “it is clear the contract DBSK signed with SM is a slave contract. He asserted in the case with SM Entertainment’s battle, DBSK’s company’s acts, according to the criminal law, can be considered as fraud against minors. He criticized the 13 year contract and especially stressed that it is a fraud against minors.

According to criminal law article 384, clause 1, “this type of fraud states that taking advantage of the lack of judgment minors or disabled people can have and thus, profits from is punishable for up to 10 years of penal servitude or for up to 20 million wons of penalty.

Following, SM signed a contract with DBSK who were minors, and thus were not in conditions to make informed judgments, and made immense profit.

He added that this case must be taken as a lesson in order to eradicate the slave contracts employed by many entertainment companies. He especially pointed out the injustice parts in DBSK’s contract.

He stated:

By setting the contract condition for 13 years, when the 5 members of DBSK were minors, SM took into consideration of their life as entertainers, and in result, tied them down for life
Upon cancellation of contract, required for penalty 2 times the amount of future earnings
Upon signing of the contract, did not confirm the original contract with the party
Concerning their earnings, required the album sales to exceed 500,000 copies for the parties to receive 10 million wons the next year

Further, he stated, “the criminal acts by SM can be accused not only by DBSK members but a third party and this must be an opportunity to learn lessons eradicate the slave contracts.”

[Lawsuit] All SM Artists Are Under The Same Contract‏

In relation to 3 TVXQ members, Junsu, Jaejoong, and Yoochun who filed injunction application to suspend exclusive clause contract, Seoul Court has been collecting all contracts of other singers under SM Entertainment and miraculously, their contract with the agency is completely similar with TVXQ.

SM artists’ contract mostly last for a long period (averagely 10 years), unfair income distribution (50,000,000 won is paid only if the album sold more than 500,000 copies), and penalty termination (3 times of initial investment and 2 times of loss). Many SM idol stars have been in the same shoes as TVXQ for exclusive contract clause.

District Court (first level court) and High Court (second level court) has come to the same conclusion, that the agreement in contract is unfair thus labeled it as “invalid”. However, Supreme Court’s (third level) adjudication has not yet to come. The artist can be said to win the case only if the Supreme Court has agreed to the two court’s adjudication, else it’s not proceed.

CF model Yoo Minho (25) in 2006 had a discord against SM related to exclusive contract as well. Therefore TVXQ’s case in not the first case of an artist having court battle against SM. Even the Yoo Minho’s contract is likely similar with TVXQ contract, which makes it more cliche. Minho’s starting contract period was also close as TVXQ’s, January 3, 2003 (TVXQ is June 30, 2003).

Yoo Minho – SM court battle lasted for 1 year and 6 months in Yoo Minho’s winning with some adjustment clauses, yet she dropped from SM, while the agency influenced the PD of her show to shut down the TV show since she’s no longer worked for SM regardless the good ratings it got.

SM seems to use a standard form in each of its contract therefore it appears that other singes under SM such as Super Junior and SNSD have signed the same contract as TVXQ.

In addition, TVXQ members requested to SEJONG lawfirm–3 members legal representative–through an e-mail on August 5th “Until the trial date is confirmed, please do not reveal anything about our stand, to avoid more court motions.”

DBSK members are angered by false truths being reported and the influence this has caused.
On the 6th, the lawyer representing the three members stated, "there have a rampage of statements given by people who were reported to be close acquaintances. The speculative and slanderous reports by them are distorting this situation. They have appeared and discussed issues such as motives for the lawsuit but they all possess some misunderstandings about the issue. Acquaintances are only acquaintances, they are not DBSK members. There is no troubles between the members. Members are not happy about what they are hearing.

Through their lawyer, the three members recently forbid all their close acquaintances from talking about this issue. Not only did all members change their contact information, they have expressed their intentions not to publicly speak about their official stance for a while. This can be seen as decisions due to the troubles that slips of tongues has caused.

The reason that DBSK members have forbid their acquaintances from talking is due to the start of rumors about troubles between the members. They have expressed multiple times that there are no troubles. However, a close friend of the members revealed that there was some trouble between the members who filed for lawsuit and the 2 members who did not. There was also rumors that after the Thailand concert, the members hunt out separately and that they acted separately even in Korea. These rumors were found to be groundless. DBSK members left to Japan on the 6th and as always, arrived to the airport in one van.

The same thing can be said for rumors that the 3 members filed for lawsuit without consulting the other two members. This time, a 'close acquaintance' of the two members showed up stating that the makeup company was the reason for this lawsuit and that the 2 remaining members remained silent in order to avoid disbandment. This acquaintance reported that if the situation worsened, the two members would file for compensations to SM and the three members.

These rumors cannot be confirmed, and moreover can make the situation worse. The lawyer and SM both revealed that these rumors are false. A staff reported, "the situation is very sensitive. The situation changes by the minute. The act by the members to forbid their close friends from talking was unavoidable."

It was written on Asihi newspaper on 7th August, “Dong Bang Shin Ki has fended off rumours for disband. Dong Bang Shin Ki had performed in Tokyo for the 30th 神宮 fireworks festival on 6th August.”

The news added, “They have assured worried fans about rumours to their disband. After the live performance that day, they had said, ‘Very enjoyable. We want to do this again’.”

The future of idol group DBSK is uncertain. DBSK’s 3 members (Micky YooChun, Xiah Junsu, Youngwoong Jaejoong) and SM’s trouble is too deep. Although they state that there will be no disbandment, in reality, disbandment is more than likely. Even if they avoid the worst case scenario, disbandment, it feels like their departure of SM is set.

On the third, an acquaintance of the 3 members said, “settlement with SM has been tried multiple times. But their differences couldn’t be settled. The reason this went to court is because they couldn’t find a point to settle.” Thus, they concluded that more attempts for negotiations was useless.

The acquaintance that the reporter met is someone who has watched over DBSK very closely. He has experienced all ups and downs since debut until now. According to him, DBSK advocated for only one thing. They wanted conditions of the contract to be eased. However, it has gotten to a point where the conversations between the two parties have gone nowhere.

He stated, “they asked for the contract term and earnings distribution to be revised because everyone could tell it was irrational. They attempted to negotiate until the end but they felt that SM was avoiding them. Therefore, things got emotional for both parties and the 3 members are even more angry with SM’s response.”

After the initial reports about this incident, SM sent documents on the 1st and the 3rd. On the first, they reported that this problem was due to the makeup company investment and they will work it out. After the contract conditions were reported, they responded that members were paid 11 billion Won and were given foreign cars as presents.

In response to this, he stated, “the nature of this instance is the unfair contract, not the make up company. However, SM has not mentioned the contract conditions and have continued to use make up company issues to play with the media.”

Additionally, he discussed about the 11 billion Won. He said, “let’s say SM is right and that they were paid 11 billion won for the 6 years of work. This is the pre-tax profit. After taxes were paid, and this amount is divided by 6 years, and 5 members, this is less than 200 million won per member. For the first half of this year, the profits from album sales in Japan is 2.5 billion Yen (33 billion won). However, DBSK doesn’t even receive 200 million won per year.”

The total number of albums released in and outside of Korea is 48. Out of these, including singles and full albums, 1.96 million copies were sold in Korea. In Japan for 4 full albums and 27 singles, 8 of those sold over 100,000 copies, and one sold over 250,000 copies. Including south-east Asia, at least 4 million albums were sold.

He also criticized abnormal methods of calculating methods. According to him, “SM requested money for back dancers and food. Basically, almost all of the expenses were paid for by DBSK.” He added, “besides this, SM created a local subsidiary and divided the earnings of DBSK into pieces. For example, SM Japan and Avex divided earnings, and this was also divided with Korean SM. With complex divisions, the money for the members were reduced.

Also, he stated that the foreign cars were given to them under the company’s name. “They received cars from SM after an award ceremony. However, the cars were registered in SM’s name and is not owned by DBSK.”

#“The three members are as tired as they can get.”

According to this acquaintance, the three members of DBSK are tired of SM’s play with the press. They have no intention to solve this with mere words, and are extremely upset that SM is exaggerating only one side of the story, distorting the truth. He said, “they expected SM to twist words with the press but didn’t realize it would be to this extent. If SM continues this method, I think it would be nearly impossible to work together with SM again. I suspect that they will part with SM and try to find a different solution to settle this.

Their departure from SM does not bean the disbandment of DBSK. He asserts that there is no problems in relationships between all the members. They are still like family and agree that in any situations, they must work together. He said, “Truthfully, all five had the same intentions. But in the process of negotiations, there was differences between the members. That is why only 3 members decided to fight with their company. They all agree that the contract conditions are irrational, it is just that their way of handling it is different.”

#“DBSK will continue even after departure with SM”

According to a ‘Mansung’ Patent Law Firm Office, the patent attorney Hwang Sung Pil said, “Dong Bang means East and one cannot assert exclusive right to use it. Most likely, this was probably the reason why the application was denied 2004. SM cannot assert any trademark rights to the name. If the 5 members are together even away from SM, they will have no problems using the name.”

More than anything, DBSK feels extremely sorry to their fans. This is why they want to go through with performances that were already scheduled. The acquaintance reported, “if they lose the lawsuit, they may have to pay an extreme amount of money for penalty. [Lawsuit] The League of Singers “DBSK Dispute is a structural problem"

The Korean League of Singers revealed, on the 5th, that this instance showed structural problems with both SM Entertainment and DBSK members.
The secretary-general of the league went on air on radio program, “Open World Today, Lee Suk Woo” and stated that “if this situation is not solved properly, similar situations will happen repeatedly. Contract periods, earning divisions, and other unfair contract conditions must be corrected.”

Lim Sang Hyun lawyer, the official lawyer for the 3 members, revealed that each member received 200,000,000 Won for their work. On the contrary, SM responded that they paid the members 11 billion won.

On this, secretary general Kim stated, “if SM did,in fact, pay 11 billion won to the members, it is still necessary to consider if it was a rational payment, if the distribution was right, and if it is an acceptable amount of payment compared to the profits made by the company. SM and DBSK is just one case; the current earning distribution structure makes it possible for the ratio of earnings to be 100 to 0 for the artist. (100 company: 0 artist). Whether it is setting minimum or maximum earning distributions, there needs to be a separate regulation for the future.” The three members asserted that their contract with SM is 13 years but in reality, is a contract for life, but SM refuted that the contract complies with the recommendations for a standard contract, which was presented by the Fair Trade Commission in July.

Secretary General Kim added, “if contract periods exceed 10 years, this period is applicable to their entire musical career. In April, it was judged that the contract period can be a clause to void contract because it severely restricts an artist’s moral influence as well as economic freedom. Secretary General Kim added that if a group as popular as DBSK are in such situations, the reality for nameless celebrities and trainees must be investigated. Further, he stated that this situation will have influence on mainstream music industry for the first half of the year and this opportunity should be used to examine the way the music industry functions.

In order to avoid relapse of the situation, he stated as a solution, “first of all, the ideal contract released by Fair Trade Commissions must be upheld by the music industry. The league of singers is considering plans which includes a center to aid for accusing companies for harm done or even developing a specific subordinate contract which will be attached to the official contract.

[Lawsuit] Law suit is only a law suit. Five members continue to move together

After participating in A-Nation on the 1st, it was revealed that the 5 members of DBSK remained at their house together during their stay in Korea. A staff of DBSK revealed on the 5th that the members stayed at their Chungdam Dong house together.

The three members who filed for a provisional disposition on their contract met with their lawyer and revealed their positions on the 3rd. In this situation, it may seem likely that their relationship with the two members may become unconformable but they remained at their house, showing the team’s unity.

For a while, their previously scheduled events will remain the same. The DBSK members will take part in the ‘2009 Fireworks Festival’ and left together to Japan on the 5th. The staff revealed, “as far as I know, the members left on the 5th on the first flight to Japan. They will also take part in ‘SM Town live 09′ as planned.”

Meanwhile, the members who are filing for the lawsuit, Youngwoong Jaejoong and Micky Yoochun is planning to participate in M-Flo’s album, as well as releasing a single, attracting attention of fans. According to DBSK’s official Japan website, the two members will take part in M-Flo’s album, celebrating their 10th anniversary, by singing “Been so long” on the album.

Also, the duet song ‘Colors Melody and Harmony’ which was performed last month on the 4th and the 5th for the Tokyo Dome performance, will be released as a single on September 30th. In addition, they are planning to perform a duet song at “Boy pop factory 09″ on the 20th.

The opposition of DBSK disbandment is getting stronger. On July 31st, ‘DBSK Disbandment Opposition’ petition began on Daum Agora and have gotten 23066 signatures so far.

It is widely know that DBSK’s official fan club Cassiopeia has over 800,000 members. These fans are considering plans to hold a candelight protest in front of SM in opposition to DBSK disbandment. In response to this, SM stated that there has not been any particular actions by the fans yet.

[Lawsuit] 090804 TVXQ Fans Speak Out Once More, “Show us the exact amount of TVXQ’s income”

Amidst the chaos that has ensued after TVXQ members YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu filed a lawsuit against their agency, the rift between the two sides is getting deeper as SM Entertainment revealed it’s rebuttal.

There is a lot of talk about SM’s official statement and many are skeptical about SM’s statement that the amount given to TVXQ was ‘a substantial income division.’

On the 3rd, SM released that, “TVXQ, till now (July 2009), have received 11 billion Won (9.2 billion Won given during the activities+1.77 billion Won given beforehand) and have also been given luxury foreign cars (bonuses that don’t have any connection to the contract).” SM also said that, “The other side has focused solely on album sales even though TVXQ receive their fair share through events, CFs and other performances.”

However, since the exact amount of TVXQ’s income till now has not been revealed by SME, SME’s statement has been met with skepticism and doubt.

Fans stated, “Even if SM did give TVXQ 11 billion Won, that is still less than 400 million Won per person each year,” and “It is not plausible to say that this is enough when the group’s immense popularity or influence is calculated,” to show their reluctance to accept SM’s statement.

In fact,TVXQ’s album sales started off with their debut single ‘HUG’ selling around 195K copies and after eight singles and four albums, they have sold a total of 2,68 million copies in Korea alone.

In Japan, they have released 27 singles and four albums and sold a total of 2.34 million copies. According to the Japanese Record Committee, eight albums, ‘Summer Dream’, ‘T’, ‘Beautiful You/Thousand Year Love Song’, ‘Why Did I come to like you? (Doushite)’, ‘Spell-MIROTIC-’, ‘Survivor’, ‘Bolero’, and ‘Share the World’ have received the Gold Ranking (100K or more) and ‘The Secret Code’ has received the Platinum Ranking (250K or more).

Even when China, Thailand and Hong Kong is not considered, TVXQ has sold more than 5 million copies in Korea and Japan alone. Oricon Magazine, the official album chart for Japan, stated that in the first half of this year, TVXQ took eighth place in total album sales that earned them a total of 2.5 billion Yen (approximately 33 billion Won).

TVXQ’s concerts also boast the best ticketing power and the income their live concerts bring in is probably a massive amount. Around 390K people attended TVXQ’s Asia Tours, 530K attended their Japanese Tours and 120K attended their showcases. In their concerts alone, they attracted over 1 million fans around the world.

One fan wrote on their blog, “The most recent concert was their Japan Tour that ended at the Tokyo Dome which attracted 300K people. Even when using the average seat cost of 8000 yen (1 yen=1300 Won), that is still 2.4 billion Yen, in Won that would be 31.2 billion Won.“

They also stated, “This is only taking the ticket fee into consideration. When you add up all the souvenirs sold during the concert and add this to the ticket cost, they must have earned at least 50 billion won.“

After the Tokyo Dome concert, many Japanese news agencies estimated that, “If you add up all the money TVXQ earns in China, Southern Eastern countries, Korea, etc, TVXQ must earn around 100 billion Won every year.”

There are other sources of income such as musical income sources of streaming, background music for homepages, downloads and ringtones, and commercials, performances, DVDs and photobooks, as well as a cartoon character venture, the amount that TVXQ has earned till now is almost out of this world. That is why SM’s statement regarding money has become an issue.

In reference to SM’s statement that “From their debut till now, we have paid TVXQ 11 billion Won,” many fans are saying that, “It’s not about the actual amount of money given to them, but the percentage of total income given to them,” and “SM is putting forth a large number of 11 billion Won to make it look like they have been giving the members proper treatment pay-wise.”

Fans also stated, “If the agency is so convinced that they are being fair and just, why is it that they aren’t revealing the exact income of TVXQ? There are too many unclear parts in this contract that even the members did not know the contents of.” They also criticized SM Entertainment by stating, “Because of SM’s poor attempts at making TVXQ the scapegoat, more questions are arising and they are causing confusion.”

TVXQ's Xiah Junsu (Kim Junsu), YoungWoong Jaejoong (Kim Jaejoong), and Micky Yoochun (Park Yoochun), who filed for a Exclusive Contract Validity Suspension and Provisional Disposition Request against SM Entertainment on July 31st, have finally released their official statement.

The three revealed today that, "For the past five years, the agency has been controlling everything and because of everything we have gone through, we are so worn out mentally and physically."

Kim Junsu, Kim Jaejoon, and Park Yoochun debuted in group TVXQ in the early months of 2004 and have been, with the order of SM, traveling back and forth from Korea, Japan and China. They have been completing their schedules by sleeping only 3~4 hours every night every single day except for one week of the year. Because of this, the three members' health has been affected greatly and the amount of stress and mental weariness they received was huge. However, the more SM got TVXQ involved in foreign activities, the more tiring and almost impossible the activities became. The three members finally began to feel like they were no longer SM artistes who were striving to reach their dreams, but mere tools for the agency to get money.But the three still wish to continue with their activities as a singer according to their own visions.

#2 The exclusive contract that was set for 13 years is in fact a 'slave contract'

When they talk of the exclusive contract, they refer to their contract that lasts 13 years. However, when they add the years they will serve in the military, the period will extend to at least 15 years which would mean that they would have to be celebrities under SM's rule for at least ten more years before they could even consider retiring. If they were to cancel their contract before the 13 years were over, they would have to pay a fine that was thrice the amount of all the investments made and twice the amount of how much they earned. As this amount would add up to tens of millions of dollars if they were to cancel their contract, they had no other choice but to stay at SM under the same conditions they are suffering because of right now.

#3 The members did not receive as much as they should have for their hard work

Just because they were tied to such a contract, doesn't mean they received fair treatment from SM for their hard work. They received no money for the contract, and when the division of income is seen for their albums, their contract states that each member can receive 1000,000 won only if they sell more than 500,000 copies of their album. If they do not reach 500,000 copies, they do not receive a single won from the income earned from the album This clause was altered on 2009.2.6 but even after the alteration, the members only receive around 0.4~1% each from the album sales.

#4 The members have tried numerous times to fix the contract, but SM did not listen to their pleas.

Therefore, the three members repeatedly asked for a suspension of their exclusive contract so they could follow their own visions of being a singer, but SM tried to move the spotlight towards the three's cosmetic company, which has nothing to do with this trial. So the three people believed that the least they could do was have the two sides talk and reach a compromise that both sides would agree on and even offered to find a proper place to do so, but not only did SM ignore this, their past and current attitude made it almost impossible for there to be any talks with SM. There was no hope for any talks to happen with the agency and that is why the three members decided to file this lawsuit.

#5 The investment in the cosmetic company was something they did outside of their activities as a celebrity, it has nothing to do with this lawsuit. The focus point is the unlawfulness of the exclusive contract.

SM revealed in their official statement that the three members were filing this lawsuit because of problems that arose because of the cosmetic company. However, the members' investment in the cosmetic company has nothing to do with this lawsuit. The company SM is referring to is the Chinese branch of the company that the three members invested in, and this was purely a personal investment that had nothing to do with their activities as celebrities. No one can say that TVXQ should lose everything they have worked so hard for until now just because of an investment of $1 million in a cosmetic company that is opening in China; that is ridiculous to even consider. The core of what the members see as a problem is the unlawfulness of the exclusive contract. SM must stop trying to move the spotlight to the cosmetic company that has nothing to do with the case.

#6 None of the members want to disband, all they want is to escape from the tirades of their contract.

They realized that many fans feared that a disbandment would arise from this lawsuit. However, this lawsuit should never be linked to the possible disbandment of the group. Only the three members are involved in this process because of a difference in opinion of a method of approach between the members, but there are no strains whatsoever between the members and they all wish to keep their promise to their fans and stay together. If they had even a small chance to fix the unlawful clauses in their contract and pursue their music careers in the way they wanted, they were willing to go through with this process with only the firm belief that all five of them would be able to stand on one stage together in front of their fans even after this ordeal.

#7 They take this as a step to become more mature

The three members are extremely sorry for frightening the fans who care so much about TVXQ with this lawsuit, but they believe this is a step towards a bigger dream. They promise that they will be able to come out of this situation as better people and a better group if they receive support from their fans.

TVXQ's Micky Yoochun, YoungWoong Jaejoong and Xiah Junsu have filed for a Exclusive Contract Validity Suspension and Provisional Disposition Request and have had people speculating a disbandment of the group. Right now, however, the opinion that TVXQ should be preserved and not disbanded, voiced by SM, the members and the fans, is gaining a lot of support.

SM stated on August 1st that TVXQ is a representative group of, not only the members or SM, but of Korea and Asia as a whole and they must fulfill that by continuing on with their activities as a group. It could be seen clearly that SM would stop any notion of a disbandment.

They have gone into finding a resolution for this dispute with Lee Sooman returning to Korea as soon as he heard the news. The key to fixing this dispute is how much Lee Sooman is willing to listen to the members and how much he is willing to concede to the members' demands.

He has been noted to be very disappointed with the fact that many are seeing Micky Yoohcun, YoungWoong Jaejoong and Xiah Junsu's lawsuit against their agency as a means of breaking away from the agency and disbanding.

When lawyer Lim Sang-hyuk, who is representing the three members in this lawsuit, releases their official statement on the 3rd, the exact details of the lawsuit will be revealed. But as of now, the three members have voiced their opinions that they truly want to stay together as the five members of TVXQ and have never thought of going off as a group of three as rumors have implied.

This means that if conflicts about the cosmetic company and the exclusive contract are resolved through a compromise, there will be no chance of the group disbanding; even a small step will suffice in this.

The three members' willingness to participate in the SM Town Concert on the 16th and the numerous A-Nation performances shows that there are no conflicts amongst the members that are big enough to cause worries or doubts and have significantly slowed down fears circulating about a disbandment.

The efforts of fans who wish to keep TVXQ as it is can be seen everywhere. On Daum Agora, a petition that was created to keep TVXQ as it is has already gained 13,000 signatures in one day. There are even talks of silent protests. However, some fans are saying that too much involvement from the fans may in fact hurt TVXQ's lawsuit and have warned other fans to just wait and watch quietly.

There is a growing concern that too much attention on TVXQ may continue on to create rumors that will make the entire process more complicated than it should be.

There have been rumors that there is a deep rift between Micky Yoochun, YoungWoong Jaejoong and Xiah Junsu's side and U-Know Yunho and Choikang Changmin's side and that the dispute between the three members and their agency ever since last April has become so irreperable that there is no hope for a solution. However, these rumors are only rumors and will only create more misunderstandings between the members and the agency and will only become a hindrance, not a helper.

The K-pop industry has been watching this sitation with concern, and many have stated that they wish this situation will end well and cut the continuous cycle of the disbandment of groups because of disputes between celebrities and their agencies that causes a lot of pain to the fans.

Lee Sooman returned to Korea to speak directly with the members, and SM Entertainment has stated that, "TVXQ is a group that represents not only Korea, but all of Asia. Therefore, all their activities must continue as planned." It has been confirmed that three members of TVXQ, YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu, have filed for a Exclusive Contract Validity Suspension and Provisional Disposition Request against SM Entertainment and have also filed for a Preservation of Evidence Request.

The Preservation of Evidence Request refers to, "Any account books, contracts, receipts, transfer slips or any other documents that will aid in calculating the exact income and expenditure of the requester," and this was done to calculate the exact amount of money TVXQ earns.

There is more controversey to come as a statement was released that the members of TVXQ, till now, have never received information about the contents of their Japanese contract.

In 2005, TVXQ signed a contract with Avex Entertainment, one of the largest agencies in Japan, through SM Entertainment and have been working with both entertainment agencies ever since.

However, till now, the members of TVXQ have no idea what kind of contract the two agencies formed, and how their income is being divided in Japan.

A representative of the law firm that is helping the three members had a phone conversation with this reporter and stated, "Ever since TVXQ started their activities in Japan, they have never been given any information about how their income is divided or what their contract consists of."

He also said, "We have tried numerous times to tell the agencies that what they are doing is unlawful and tried to convince them to show TVXQ the contract, but both agencies have been ignoring us," and "The members have been diligently working for this company without even knowing exactly what kind of contract they are under."

The Sejong law firm lawyer who is in charge of this lawsuit informed reporters in an interview of the problems regarding unfair division of income and complete honesty with the members and also stated that "We have not discarded the notion of filing for compensation later on."

Avex Entertainment, who is in charge of all of TVXQ's Japanese activities, wrote on their ofiicial website on August 1st and stated that TVXQ will continue on with their activities regardless of the current lawsuit.

[Lawsuit] 3 Members Separate Meeting: Upcoming Schedule Matter

TVXQ, a group who is currently meeting dissolution crisis right now had arrived on August 2nd at 3 pm at Gimpo International Airport. They just finished their concert schedule in Japan on August 1st (T/N: a-nation in Kumamoto) and hastily went back to Korea. The very first time 3 people and 2 people who has been reported to break up were shown together in well condition in Gimpo arrival.

However, the upcoming activities of these people are expected to show different directions. Micky Yoochun, Xiah, and Youngwoong who have submitted injunction application against their agency SM Entertainment regarding the suspense of exclusive contract are reported to be having evening meeting in certain place in Gangnam.

The lead legal representative of the 3 members said, “This evening, the three members including their parents and lawyers will meet to discuss plans for future activities,”

According to the legal representative from SEJONG law firm, lawyer Im Sang Hyuk, the future plan of TVXQ will likely to run separately. A predetermined schedule that is already appointed with the fans will be proceed without disruption. However, for the newly created schedule whether all members will be attending or only part of them is a plan that is going to be decided through the discussion.

From lawyer Im Sang Hyuk, “What we have promised to fans, is the most important. For overseas activities in the schedule, because we have already agreed to many fans, therefore they will be proceed. Including the overseas tour in Japan: 8th at Ehime, 22nd – 23rd at Tokyo, and 29-30 at Osaka, all members are going to performing on stage altogether.”

In the other hand, for the domestic activity is still undecided. Members are likely divided to 3 and 2 for local activities. Lawyer Im said, “Currently, from SM side wanted to know about the future of all schedule which was already prepared. Therefore to decide that, Micky Yoochun, Xiah, Youngwoong, and another representative of the 3 guys will discuss whether to receive the schedule and participate or not.”

The cause of this incident between SEJONG and SM Entertainment is the unfair contract. “The core problem is not about the cosmetic company. But SM seems to continue pointing the cosmetic company as the problem in their statement. The main problem is the unfair contract, and our injunction application is to meet that purpose.” Lawyer Im stressed it again.

Korean popular group TVXQ recently met some conflict with their management company, creating a disbanding rumor that drew lots of attention from fans. On the 2nd of August, it was said that on the search ranking on China's Baidu, 1st was 'TVXQ disbanding.'

TVXQ, a vocal group composed of five men who debuted in 2004 and had since been getting lots of attentions from fans from Korea, China, Japan, Thailand and Malaysia - a group that has a lot of popularity in the whole of Asia.
They had placed their attention on the activities in Japan, learning and living in Japan since then, having 29 singles since their debut 5 years ago and most of their singles are appearing on many shows and radio.

Last 31st of July, three members of the group sued their agency, SM Entertainment on the name of canceling one of their contract terms. After this news was released, the Korean media started the rumor saying that the group would be disbanding.
Such posts soon appeared in Baidu; "disbanding crisis," "disbanding possibility," "disbanding in August." The reason of these happenings is because the group had decreased most of their Korean activities, placing their attention in Japan and some members having to open cosmetics shops. It was said that the concert in September or in October that would be held in Shanghai would be the group's last activity together. Korea's legend of five years would then disband from there.

Comments to such articles were "Could be?" "They can't disband!" "TVXQ are only 5 together!" "Cassiopeia believe!" and other comments found were rather fierce.TVXQ's bulletin board were full of these comments ever since the news was reported.

Also, there were some theories based on the boys' recent activities that made others think they were heading for disbandment. The whole Asia is still watching for the fate of this group.

- What do you think of Saipan?
JS: This is the third time I'm here but the vacation this time is the best.

- Why is it so? Are there any incidents that have left a deep impression on you?
JS: It's been a while since I've been to a vacation site and my mood is rather good too. There is ping-pong there and we played it for a very long time, it left a deep impression on me. Also, the members all drank beer in the evening and sang on a LIVE CLUB stage.

- During the promotion for Mirotic, you did alot of exercise. Other than playing ping-pong, do you do alot of sports during your free time?
JS: I have already set my heart to do sports, other than that, I also play games, watch movies, just like normal times only more relaxed. Sleeping too, and since I like soccer, I also play soccer.

- Your favourite sport is soccer? Do you have a team?
JS: Correct, my favourite is soccer. During our stay at Saipan, we played indoor soccer, it was very interesting.

- What did you do during your free time before Saipan?
JS: I went home and it has also been 6, 7 years since we had a family outing. We went to the beach, ate raw fish. Although it is not a very special occasion but it was definitely worth treasuring and I enjoyed it alot.

- If you have a special off-days, are there some things that is a must do? What do you think is the secret to spending your vacation happily?
JS: While being on vacation, I would usually wonder "I want to do this, I want to do that" and have alot of plans but when the vacations are over, I usually don't do any one of those. On the contrary, I would not want to go out and get a headache deciding on where to go. If I have time, I'd rather stay at home.

- Then, in the future, if you have any more vacations, what do you want to do the most?
JS: HOLIDAY!

- And to where?
JS: Although the main reason of us coming to Saipan this time round is due to filming, but I did feel abit of a vacation. Sleeping on the island, drinking coconut juice and have also become even closer with the members.

- Do you like places that are similar to Europe?
JS: I like places that are more soothing instead. Places with coconut trees seem to bring about more comfort. (T/N: <3 Be careful not to get hit by the coconuts!)

- What do you feel about Saipan?
CM: Although we have already came thrice, but I still feel that this time was better because it was really interesting.

- I heard that you had a few days off before coming to Saipan, what did you do during that period?
CM: I met up with friends and drank together, ate together and climbed a mountain myself. It has been about a year since I saw my friends so I used this opportunity to meet up with them. If I have extra time, I would also go for a few courses regarding singing. (T/N: Always hardworking Changmin )

- Do you have any secrets to spend vacations happily?
CM: Talking about rest, because we have gone through a full year of promotion and activities, compared to planning on where to go, I rather pass the days quietly. Other than meeting up with friends at night, I don't go out and stay at home to listen to music.

- While vacationing, compared to cities, you seem to prefer places that are more soothing?
CM: Although I rerally love quiet self-mediation places but if I have the chance, I would like to go to New York, a place where there are alot of people.

- Recently in vacations, do you have any deep impressions of anything?
CM: Driving by mself. Driving aimlessly, not really wondering where to go. If I'm around Seoul, I'll go back and proceed on to Incheon then going on to Gyeonggi-do then climbing a mountain and proceeding home while listening to music.

- Do you have any plans for the rest this summer?
CM: Although we did not have a rest this summer but if we did, I would like to go to Paula Paula Island (T/N: No idea what this is, directly translated) with my lover. The last time we had a family outing was 7, 8 years ago so I would like to go on a holiday with my parents and sister. I'm not sure if it could be fulfilled.

- If you had free time, would you like to do alot of sports?
CM: The members all love sports. I like exercising myself but I also like doing it as a group.

- Are there any incidents that left a deep impression on you this time round in Saipan?
CM: On the last day, me and the workers were chatting while walking, the members were sitting at the sea side at the far end and were drinking beer carefreely.I really miss that night's last meal, every moment has left a deep impression.

- Think about a future you?
CM: To be able to have a happy family.

- Of all the things you have experienced in Saipan, were there any that left an impression?
YC: Picking coconuts to eat. It seems like I was able to open a few coconuts with just one move. This is a first-time experience. It held a real wildlife experience. And also, going to the beach after visiting a beershop. In the evening, we were drinking beer together with the staff.

- Do you have any plans for this year's summer vacations?
YC: We must have our rest days first..

- During vacations, where do you want to go and with whom?
YC: I want to go to Switzerland alone.

- Alone? What kind of person are you?
YC:To be honest, I'm the kind of often feels lonely and that's how my inner self shows.

- It seems to fit an Europe holiday.
YC: I personally like Switzerland. For Europe, I like Brazil and Czech Republic.

- Do you have any special reason for your liking for Switzerland?
YC: I have come across some nice background scenery of Switzerland and I like them alot. After going to Switzerland, I'd like to go to Provence.

- If you have a lover, where would you like to go?
YC: I would like to go to a place with a good atmosphere. First thing that I want to do is to bring her out at night after a day at work.

- Which vacation left the deepest impression?
YC: I can't exactly call it a holiday. It was in Japan and we left for the hot springs. Everytime we go there, the memory is precious to me.

- During the activities in Japam, what would you do when you go back to Seoul?
YC: There really is alot of things. I would like to drink and of course my tolerance is not bad. I would like to see Korean staff overseas as well so when I go back, we can drink together. Although I don't really like a crowd but I can manage drinking with the staff,

- You don't like to go to a place with a crowd in Seoul?
YC: I don't go. I usually go out in the evening. If it's in the morning, I'd feel dizzy. (T/N: Ofcourse, since YC Isn't a morning boy!)

- What do you think about Saipan? Did you film a lot of sports scenes?
JJ: The things that happened were more than expected. It was a holiday full of interesting scenes and also, hardship.

- Were there any things that left a deep impression?
JJ: Because I had to become a MC, it was quite burdensome and hard, to be honest. (T/N: <3 We're here!!)

- Do you have any special plans for this year's summer holidays?
JJ: Actually, we had no vacations. But if we had the time, I would like to go back to my hometown and meet up with friends. During the rest before coming to Saipan, me and my friends went to China. (T/N: ZOMG AND NO ONE REALIZED?!?!) Although the time was short but we ate alot of delicious food and played alot.

- Where would you like to go if you had a vacation?
JJ: I would like to drive to different places. Not Seoul but to a quiter place.

- Is there anyone you'd like to specially go with?
JJ: If I had a girlfriend, I would go with her but it's okay if I'm going alone as well.

- Why would you want to drive there?
JJ: Compared to China, I prefer to drive to places. It's relaxing and comfortable. (T/N: wasn't driving stressful?!) I can also bring alot my favourite songs. If I like someone, the thing I would want to do would be to bring her along. Ah, and on our anniversary as well.

- What kind of music would you want to listen to?
JJ: I don't really have a specific genre for music.

- In your previous vacations, which one has the deepest impression?
JJ: Going to Paula Paula Island with the members.

- Is there any special reason?
JJ: It is the most beautiful island to date, and is a good self-meditation place. As we had to go there to have a shooting for a poster, it is a place full of good memories.

- Personally, if you go for a vacation, do you prefer cities or self-meditation places?
JJ: It;'s not either actually, I just like to go to a place. Even if it's not somewhere far, I like to drive to different corners. There is also another reason - because I hate the sun so compared to the day, I prefer the night although it might be a little dangerous. (T/N: Jae, the pretty boy who can't stand the sun XD)

- During the activities in Japan, what would you like to do if you go back to Seoul?
JJ: There is no special thing, just meeting up with friends and drink.

- Is it very stressful and troublesome to have security following you?
JJ: I'm used to it now and have already learnt how to face it.

- How do you reduce the stress?
JJ: Composing. Once I have the time, I would compose and relieve my stress at the same time.

- What do you think about Saipan?
YH: Although we have been exercising the whole day but it is rather interesting to film in such a carefree environment. When the shooting ends and we drink together with the staff, play ping-pong and swim at night. It was really enjoyable. Although we are always shooting and filming and we feel tired but we will show everyone our comfortable and enjoyable self and let the fans who see this feel like coming here as well. That is why letting everyone see our genuine self is not something bad.

- During this period, are there any things that left a special memory?
YH: It's swimming and playing basketball in the water with the staff. We also played hide-and-seek, ate and chatted freely together. It really is a deep impression. (T/N: Omg, hide-and-seek, dorky them XD) It is just like going to the army with my friends. Our members have never ended army during their university period but it really feels like army.

- Do you have any special plans for this summer vacation?
YH: If I am unable to go to Las vegas, I would like to go Jeju Island. If there is still time after the shooting today, I would like to go to a clean place to walk around. To be able to go to a place where not many Koreans know isn't too bad. Our country has alot of beautiful places to go but there are also alot of places that we haven't went.

- Where would you usually go during a vacation?
YH: This time we went back to Gwangju Metropolitan City. Firstly, I went to pray to the ancestors and then proceeding to the elder village and gave my grandparents delicious food. I ate with my family and went back to my former school. Actually, because my parents like to help others, I have learnt to do that unconsciously as well.

- Which part of Seoul do you like the most?
YH: Since I was born in Jeolla-do, so I have deep feelings for Jeolla-do. But I also like Seoul.

- Do you frequent a place in Seoul?
YH: I occasionally go to Seoul Tower. I'd go to the roof by myself and since I like the sea, I would also go to the seaside with my friends.

- If you have a lover, where is a must go place?
YH; Of course a tourist attraction especially the Santorini Island. If I go with my girlfriend, it would be very romantic. I would also like to bring her home and let her see the place I was born in. (T/N: -raises hand- , me please!)

- Is there a place that has left a deep impression?
YH: I remember going to the nami Island in Chuncheon with 6 boys wearing high school uniform last year. I like going out with a bunch of guys. Riding a motorcycle, sitting on a boat is a very recent interesting vacation memory.

- During the activities in Japan, what would you do in Korea if you go back? Of course it is if you have the time to.
YH: To go out with my members and friends. As we hardly have any time so I would like to go out and play when there is time. But in reality, time that actually belongs to yourself is never there. Ah~ I would also go for a holiday and go bowling.

- Alot of popular people will leave a long impression on others. What does Yunho want to be?
YH: To be able to enjoy life every day, even if it's hard, I would work hard. Although I don't really like leading life to be too ideal but comapred to a 100 dreams, I think it is better to have a 1000 dreams. For goals, I must have a 1000% determination and work hard even if I can't achieve that much but at least I would reach 999% so I will use all my strength before I succeed. In the future, I would like to become the responsibility of those who want to be able to become the driving force of our country, but until now, there are those who are finding a hard time find an opportunity. Although I am unable to see the results of the future right now, but if I start working hard now, I will become proud of myself one day, right?

- Are you contented with your life now?
YH: When I just started, it was quite hard and it wasn't easy to get used to it. I would also occasionally suspect if I did the wrong decision. Because my surroundings are gradually changing, I feel that life is abit wild at the end. I will work hard until I am able to do very good.

“We would like to sing a song which remains in memory”

In Japan we’re TOHOSHINKI, in Korea we’re TVXQ. While those two are actually similar, yet somehow it feels different, but while we’re doing long activities the two names get closer and closer bit by bit.

When we did the Japanese debut, we were already popular in Korea, yet we were still no one in Japan. Honestly, at first we were confused of it.

Also the system of the two companies are different. In Korea, after 1 album is released in a year, afterwards by several month promo activities are done, but in Japan, we have been busy to do the whole promo activities even from a year before.

When we hold concert in Korea and are singing ballad, audiences are singing together in a big voice, but the Japanese tend to stay still and are listening quietly.

At first when I saw them quiet, I was in shock, didn’t my song reach them? But now I understand that it’s all because the different culture and everyone is actually the same (in excitement) so it’s all right.

My dream as the time passing, is to continue singing nice songs which remain in memory of people. I think that’s the happiest thing can happen to an artist.

“The culture and language are different”

When I was in 3rd junior high school, I was scouted, and entered into the entertainment world. Entering entertainment industry which I didnt even know what it looked like before, yet once I passed the audience, the lessons given to be an artist were piled up.

The first time I decided to enter entertainment industry, my parents highly opposed, but I did persuade them a lot, and finally they let me go and do what I love. My participation in TOHOSHINKI is now still supported whole heartedly by them.

To work in a foreign country, as language is important, I watch many Japanese dramas and movies to learn Japanese. The word, “let’s go and see” is one I still remember until now.

Between Japan and Korea, the culture and character of the people are different. When we’re active in Japan, we don’t only change in term of music, but we also try to adapt in the life aspect. Right now we’re really busy, however if we receive a long holiday, I’d like to heal myself in a place of many green trees such as mountain and forest where there are not so many people in it.

- Changmin

“The joy is multiplied 5 times while the sorrow is divided to 1/5″

The members’ images that I see… Junsu as the mood maker, Changmin as the determined youngest, they play important role, it’s settled. Yoochun the romantic while Jaejoong is the realist, it creates a balance. I myself just realized this yesterday, therefore this question really is in good timing (laughs).

In the past, as the leader, I had to appear first and pulled everyone out. But now as everyone has grown, the necessity to do that has gone. Sometimes you may notice it’s Changmin who takes that job of mine (laughs).

Now, I’m not a leader, I’m just a part that complete the missing one as a teamwork.

We as 5 people works together is a fate. We see all of us equally. When we’re in joy, the joy is multiplied by 5, while when we’re in sorrow, the sorrow is divided to 1/5, it’s a pleasant thing.

TOHOSHINKI is my house which becomes my home. Even when I’m going to the distance, once upon a time, it will always be an important return place of me.

“I feel the charm of song that has many secrets”

I self learned piano as I always love the sound of piano since I was young. When work ends, I would just sit down in front of piano, and the melody is coming down naturally to my mind, it’s my way to relieve stress.

Writing lyrics and composing are things I used to do by my own will, but now when it reaches the point where everyone requests me to do that, I feel a little pressure (laughs).

When composing ballad song about love lost, it’s often that the song is written based on self-experience. But for me, instead making the whole of it based on experience, I tend to compose it a half by experience and half by fiction.

OST of movies is personally one I like to listen. Soundtrack has many secrets to awakening imagination. Especially for now I love to listen to soundtrack CD “Between Calmness and Passion” (静冷と情熱のあいだ).

"I want them to know more about us"

It’s been 4 years since we began activities in Japan. I feel able to work well and make progress in my Japanese. I’m now accustomed to variety shows (laughs)

We appear (in variety shows) to enjoy each opportunity that people will get to know more about us.

In the tour that started in May, Junsu was injured by accident, but it’s being so delightful to see the increasing number of audiences. Our male fans in Japan are also more than ones we have in Korea, it really becomes encouragement to us.

TOHOSHINKI songs are also now broaden from anime songs to dance songs, and as the range is so wide, even in the concert we received audiences from children to adults. The fan base is wider compared to one in South Korea.

Eventhough now we’re accepted in Japan, honestly I still have lack of confidence. I’m still thrilled to see so many people from stage, but there are so many of them still don’t really know about us, therefore we need to work harder.

Actress Aya Ueto, poster child for the new CM for『Oronamin C Drink』and guest characters Korean-born popular group, Tohoshinki, participated in the press conference that was held on 7th July. The popular group had just had a successful 2-days at the Tokyo Dome, and this is their first collaboration with Aya Ueto, who said "I'm happy to monopolise" with a smile.

In passing, as it was the Festival of the Weaver/Star Festival today, when asked about the ideal image of stars, they revealed, "Someone who is able to hold out till the end is good. A person who is distant but established".

For the new CM, Aya Ueto dresses up as an OL (T/N: Office Lady), and the content also includes Tohoshinki singing in acapella. Looking back, Aya Ueto said, "Everyone was friendly and talked, so we were all able to loosen up". Jejung gave high praise and said, "Ueta-san has a cute image, but if you see her close up, she's a beautiful woman. It's our first time (collaborating) and the atmosphere was good", and it seems that they are very compatible.

Aya Ueta who appears in the『Oronamin C Drink』CM attended in a red yukata, told the press that her wish for the Festival of the Weaver, "It's been a long time since I participated in a live during summer, I want to perform in front of a large assembly of people," expressing her excitement at returning to the music scene after 2 years.

On the other hand, Jejung said, "Personally, I want to go on a date with a lover. But I don't have a lover, and I haven't gone on a date for years. She should have the 'Genki batsuratsuu?' feeling" mixing in the slogan of the product they were promoting, which appealed to the audience.

This is Aya Ueto's 17th participation in a CM, and it will become Tohoshinki's first domestic Japanese CM. 『Acapella Shinki』the new CM for『Oronamin C Drink』will be broadcasted nationwide on 11th July.

On the 5th, Korean dance and vocal group Tohoshinki held their final performance of their national tour at the Tokyo Dome (Tokyo Bunkyo), and sang a total of 32 songs including their new single「Stand by U」which went on sale on 1st July.

Tohoshinki debuted in Japan in April 2005 with their single「Stay With Me Tonight」. Although they were already stars in South Korea, they started out as a new group in Japan, energetically doing activities and events. Their efforts earned them 5 consecutive number #1 rankings on the Oricon Weekly Singles Chart, from the single 「Purple Line」that they released in January 2008. This position is a record that they still hold today, and at the end of 2008, they made their debut appearance at the Kōhaku Uta Gassen.

The national tour that began in May covered a total of 9 cities with a total of 21 Lives. It was attended by 300,000 people altogether with the last 2 days at the Tokyo Dome which drew 100,000. They are the third among Korean artistes who have performed at the Tokyo Dome, including artistes like Rain (Pi) and Ryu Siwon.

They also performed their solos at the Live. Junsu performed a brilliant dance「Xiahtic」with a female dancer, and Yunho descended onto the stage from the ceiling for his performance of「Checkmate」. Jejung and Yuchun (23), performed a duet 「ＣＯＬＯＲＳ（カラーズ）〜Ｍｅｌｏｄｙ　ａｎｄ　Ｈａｒｍｏｎｙ」which is the theme song for the 「Hello Kitty 35th Anniversary COLORS」.

The DVD off the Live performance will be out on sale on 30th September.

According to the Korean media, Korean singer BoA and popular group Tohoshinki, together with other top Japanese singers, will be participating in the large-scale "a-nation 09" concert tour. Organised by one of the biggest Japanese entertainment companies, AVEX, a-nation has been held annually since 2001, inviting current top artistes to perform.

On the 15th, AVEX announced the second half of the list of artistes participating. BoA is finally able to take time out of her busy schedule, and will be attending the opening on 1st August, as well as the 2 large-scale performances that will be held in Tokyo on the 23rd and 24th August.

Tohoshinki, who have already confirmed their participation in April, will be attending the opening on 1st August. Following that, they will be joining Japan's top artistes in Ehime on the 8th August, Tokyo on the 22nd and 23rd, as well as the performances in Osaka on the 29th and 30th.

This year's "a-nation 09" will have it's opening at Kumamoto National Park (Kyuushuu) on 1st August, followed by the usual 1 month concert tour within Japan. Besides BoA and Tohoshinki, other top singers include My Little River, Koda Kumi, Every Little Thing, and more.

During the tour, they announced that their new single, , will be released on 1st July, and the song's preview has been released. Following last year's , it's another sad love song this summer. The song, destined to be popular, has been completed, and from the 5's vocals, you can hear their thoughts... thinking of their most important "You".

-- is a sad love song. I thought at first that this year's Summer single will be a light-hearted Summer song, so I was a little surprised.
CM: You thought that it would be a single similar to right?
JS: But last year, the song that we released, , was a mid-tempo song~.

--Because last year's release was , so I thought this year's would be a light-hearted Summer single.
YC: bu~~~bu~~~ (imitating a police siren?!) Your expectations are incorrect (laughs). But and are both mature, mid-tempo songs.
YH: It's different from the songs Tohoshinki have sung so far, and the male lead's age is also a little older than that of .
JJ: Although and are both songs about breaking up, if I compare and place myself in the male lead's shoes, the feeling that the female lead in is "too much" is more, as she didn't even say goodbye before she left. To experience this kind of break up, the sadness is doubled I guess.

--But maybe the female lead didn't have a change to say goodbye before leaving?

YC: I think the lyricist, as a man, put these kind of indescribable feelings into the lyrics, as there are some men who no matter how much they miss the other, are not able to verbalise it.

--The part Changmin sings "I can't continue this difficult journey forward holding on to these sad feelings~~", it's trying to say that you hope that the male lead can let it go, even if it's just a little, right?
CM: Yes. Although he won't be able to forget his girlfriend, he can make changes to his emotional state. When we were recording the song, not only did we want to capture the man's heart-broken feelings, but we wanted to capture the change within that as well, so we took extra care when singing.
JS: In order to show the reality of the feelings, we sang it many times.
YH: These kind of lyrics, because of the feelings and the way we sing it, it will make the performance of the song different as well.
JS: It's because the feelings are real, that's why it will move you; singing the lyrics just as if we were speaking it.
CM: That's right, the lyrics are quite realistic. For example, hoping to see her name appear when the phone rings, I'm sure everyone has experienced that in real life.
YH: When you see a back similar to your girlfriend's and it reminds you of her, that's very real too! So, not just for men, but women who have experienced a sad love as well as a break up would be able to understand that feeling too.
JJ: No matter how old we are, this is a song that we can keep singing; that's how real the lyrics are and they also represent a man's heart at the same time. Our experiences in future will also definitely coincide with what the lyrics represent.
YC: If there's a chance, I'd like to sing an "answer song" that shows the female lead's feelings.
CM: That's not a bad idea.
YH: It's a fresh idea, a Tohoshinki break up song that shows the female lead's point of view.

--Before the CD hits the stands, you've performed this during your Live tour. How does it feel to sing this during the Live?
CM: I hope that we can show everyone the true meaning of the lyrics. To be able to show the depth of feelings.
YC: I hope to tell all the women in the Lives that the men they loved in the past could still hold the same feelings, and have not forgotten them.
JJ: For this song, men and women will feel differently towards it. I could tell by seeing everyone's expressions while singing it during the Lives.
YH: On the men's faces, you can see the "Yes! It's that feeling!" expression. Maybe they didn't even realise it themselves.
JS: The females will have the "thinking of the past" expression. Maybe they didn't realise it too. (Laughs)

“Unable to leave the blissful past, I’m currently in darkness..”
- This year’s summer song is a slow romantic song.

YC: Mm, although this song does not sound like usual summer pieces, but it does bring about the kind of loneliness you feel on a summer night.

YH: Till now, there are a lot of songs similar to “Sky” and “Summer Dream” that have a carefree summer feeling. Although on the surface, the song “DouNUMBER 2e kimi wo suki ni natte shimattan darou? (Why did I like you?)” that was released last year and “Stand by You” which will be released this year do not have this carefree feeling but we want to let everyone experience a summer day full of meaning and show everyone that we have matured.

- Instead of using a slow melody, you guys have used a medium tempo to bring out the feelings effectively.

YH: Yeps, the advantages of a medium tempo is that it is able to adequately bring out the feelings in the song, even more matured than the lyrics of “DouNUMBER 2e kimi wo suki ni natte shimattan darou? (Why did I like you?)”.. It is very suitable for a “Summer Rain” song.

CM: Although “Summer Rain” is not a very dark song however, it does make others feel that there is very little unfocused light.

JJ: Wah! Wah! Changmin-ah! You actually know these kind of feelings? (Eyes Changmin suspiciously)

- If Jaejoong is going to continue being like that, I will explode in laughter. (Laughs)

JS: Eukyangkyang! He is going to start telling the story behind his first kiss again. (Laughs)

YC: Yes! Yes! (Laugh) During one of the performances, Changmin introduced the song and said, “I hope the lyrics can make everyone’s shout can be resonated around the venue!” As Jaejoong was teasing Changmin then, he countered that by saying his first love story (laugh) in order to not lose to Changmin (laugh).

CM: It’s real! (Laugh) It makes me seem like I’m older! (Laugh) Also when I was singing “when the phone rings, how I hope that it would be you, that’s how I live my life everyday~” (T/N: From Stand By U) This part is very real and I believe that a lot of us can imagine this as well. Although the lyrics of the song are descibing about what happens after a break-up, but if you still love that person, you’d still think of the person and would always hope that he/she calls you. As almost everyone has gone through this phase, when I sing this, I would usually be very emotional.

JS: Yeah.. (Sighs) It is indeed a very splendid song.. (Starts singing)

YC: You can feel the time flow and everything that happened through this song. So long as you still love the person, you would have this kind of feeling, no matter the season or time.

JS: The song “Taxi” is a song about loving a girl that is already attached although it uses an “unable to face reality” kind of remorse to perform. However, the song “Stand by You” is a song about the feelings towards a lover who has left and the fact that they are “unable to meet”; it is very sad. That is the difference between the songs.. Ah~ It’s still very sad~. During concerts, I would always feel like crying when I sing these two songs. No matter which song, it shows the hurt that an emotional boy would feel so my heart would always seem like it is being dragged down by sadness..

YC: “The hurt that an emotional boy would feel”.. Junsu.. So cool~~

JJ: I think that the part “Only when I’m beside you would I be able to see the bright light although it is impossible to repeat those happy moments” is the part that hurts most.

JS: Yeah yeah yeah! I think that the part “no matter what happens, no matter what I lose, I will never forget that I loved you once” is the part that hurts most.

CM: Junsu-ah! Jaejoong is answering, please endure abit. (Laughs)

YC: (comforts Junsu) (T/N: OOO, YooSu love much??)

JJ: I feel that the feeling is similar to the case of the male lead being in darkness all the time, unable to see light and that he cannot leave the happy memories behind and in this darkness shows the memories of him and his ex-lover…

CM: The male lead, from my point of view, is one who when reminiscing the past, is determined that he will find hope and continue his life. Although the melody is soft and gentle, but the feeling is similar to that of being in darkness and only able to see a small ray of light.. Just like to black and yellow, it’s that kind of feeling.

YC: I think that the feeling of this song differs from individuals and their current situation. Although sometimes a dark past would appear in my mind, but like the male lead, I would want find the light, a small ray of hope. As I am a very emotional person and cry alot, I can easily cry when just reminiscing a small fragment of a sad memory. The deeper the hurt/cut goes, the heavier the memory is but sometimes I think it’s a blessing.

- Yoochun’s meaning is indeed very deep ^^
JS: (falls into his own world again and starts singing) ah~ ah~ it’s still very sad.

- In the PV, we spot DBSK with black and white suits.. is there any special meaning behind it?
YH: There is actually no particular meaning for the suits. I personally think that one would have gone through alot of different situations. Usually one would want to go on with their life with full concentration but sometimes we stumble onto situations which question on our determination… The filming location of this PV was in a church at Gunma Prefecture and since there are 2 PVs this time (drama version and DBSK version), everyone can take their time and enjoy them.

- The couple tune “Tea for Two” is indeed a song full of happiness and bliss

CM: Mm, yes. I feel that this song is sang by the main lead of “Stand by You” during his happy times in the past.

YC: I think it’s the opposite! “Stand by You” was the past and “Tea for Two” is the present. A couple that broke up realizes that they cannot live without each other and returns together, just like the past, HAPPY ENDING!

YH: I think the same way too!

YC: See~? Love is like that, constantly repeating itself.

JJ: My opinions are rather different from the others.. The male lead in “Stand by You” had never forgotten the past and when he remembers it alone, the song “Tea for Two” plays.. So “Tea for Two” is just like a dream that he had!

- Everyone’s opinions are indeed very meaningful~ So what about you, Junsu? You seem to like songs that give out an “unfulfilled love” kind of meaning, such as “Beautiful You” and “Taxi”. These kinda songs are very naive and suits Junsu. (Laugh)

JS: Does that refer to a lover that would still make food for me to eat? (Laugh) Mm.. not bad not bad (Shy) It is very ideal.

- What if the food isn’t very nice to eat?

JS: Oh~ This is the first time I’m being asked these sort of questions~ (Laugh) Even if it is not very nice, I’d still finish up everything and say that it is very delicious. As compared to taste, the fact that the food was made with a sincere heart makes me happier. Because the song is a very sad and full of hurt, the male lead would still endure the taste of it and finish it up, right?

YH: Yeah. I would also pretend that it is very nice and finish everything and then secretly drink water. (Laugh)

YC: How can it be not nice!! It is made by a person whom you love dearly, of course it would be nice! Even if it is “delicious”, you must still say it out!

JJ: I think so too.

JS: You see, guys are always very kind. However, I think differently from all of you.. I think that “Stand by U”, “Tea for Two” and “Why Did I Like You” tells a story in chronogical order.

- In the song “Tea for Two”, the feeling of bliss can be felt just through the vocals. It has a gentle, caring sound to it, and each member sang for quite a long period but it is still very smooth.

YH: Yeah. We usually perform it with a happy and gentle mood~ so that you can hear it just from the vocals. Even before the song, I do feel a kind of happy atmosphere myself.

- The lyricist for the song “Sky” is H.U.B right~

YH: Yeah, until now, H.U.B has written alot of songs for us but most of the time H.U.B writes about the little happiness we feel in our daily lives and lyrics that are full with LOVE. This time round, the lyrics have become the real feelings of the male lead.

- In this song the B part (T/N: I think it means B Chord) is being dragged for quite a long time, who sings the low part~?

YC: Me and Yunho.

YH: This part is very hard~ We have to practice extra hard for the LIVE.

A new, very quick project thought up by the staff of O! forums. We all know that the boys are going to be performing at the Tokyo Dome which was their dream and now it's coming true, so we want to show them that we are 100% behind them, hence the predictable name 'Stand By You.' This project is very simple and must be done very quickly... Why? Because we're giving this along with the Yoochun birthday project to the boys at Bangkok and the concert is June 27/28 so it must be done soon!

What you need to do is make fansigns with words of encouragement like 'DBSK fighting,' 'Congrats for Tokyo Dome,' anything that's encouraging as long as it can fit your signs and make sure it's all in ENGLISH. Make sure when you take a picture, the message can be seen! Also make your fansigns stand out and that the picture you take is 900x600px, no more, no less or your fansign will not be accepted.

We're creating a DVD so your pictures will be shown in a slideshow sort of way (together with a video that will be done by the staff), something simple but still meaningful and I'm 100% sure the boys will love it!

As for the delivery of the gifts, we have Plan A and Plan B. Both are guaranteed to work, but we’re still deciding on which plan to use / waiting for more confirmation. We’ll keep you guys posted (:

Everyone is alright? Ever since morning, Tokyo has been so cloudy.
KUBUDO recording is finally arrived to the final round, I’m working hard right now.

3 years ago, I wrote song for Tohoshinki “Asu wa Kuru Kara” which becomes bonus track of their latest single “Share The World” released today.

At the time the song first released, it became ending theme for anime ONE PIECE. The lyrics was written together with Mai Osanai, we collaborated to finish the lyrics of this song, supporting each other.

Flower blossoming in spring, summer ocean, spring twilight, and a place filled by winter sunshine. Regardless the season, but praying each time to get in through that moment again.

The lyrics was written that time was likely very difficult Japanese for them.
However as they already stepped across the country border line, with a courage in heart to send the lyrics out, they’re working hard to learn Japanese. I was touched and got strength from that, I feel like those memories are just very recent.

Actually, when I was in backstage seeing them, their simple direct stares were really shocking me.
In live performance, I saw Junsu singing the lastest part of the song just like he’s shouting a story, a heartbreak which was hard to be told. At that point, my tears fell down.

3 years later, today, they don’t stop growing more and more mature. In the new single recording this song, I feel very happy from the deepest heart of me. I want to say this to them: “Thank you for singing my song,”

The spreading of influenza in region of Kasai, Japan makes a lot of new artists to cancel all performances, however the current national tour held by Tohoshinki is not yet affected.

Tohoshinki is now running their 4th Japan tour The Secret Code, which was begun in Kobe (May 4th -5th), Saitama (May 9th – 10th), Sendai (May 16th – 17th), etc.

On May 21st Tohoshinki’s spokesperson Song Hwang Ri said, “On May 23rd – 24th, Tohoshinki will have concert in Sapporo and Sapporo is not in Kansai region.”

Thus, up until now, Tohoshinki’s 4th live tour in Japan will be able to run safely. But the problem will raise in the mid-June, where Tohoshinki’s concert finally is scheduled to be performed in several cities in Kansai region: Osaka (June 10th – 11th, June 13th – 14th) and Nagoya (June 18th, 20th, and 21st).

For Kansai region in Japan is currently stated as new influenza pandemic, Tohoshinki’s concert can’t guarantee to be held as scheduled in those areas. There’s one popular singer’s performances which was originally scheduled to be held in that area as well, however due to the spread of influenze cases in Kansai, has been recently canceled.

Meanwhile, Tohoshinki’s Tokyo Dome The Secret Code concert will be held on July 4th – 5th as the last show of the tour.

[BLOG] Zoom In Super MC’s – Oguma Mika’s Blog - Attending TSC Tour

On May 9th, I went to see Tohoshinki’s concert ^^

Usually they always show a light and open persoalities when are interviewed and shot in an open air, but at the concert their serious expression and vigorous dance are really perfect!

Mr. Nishi and I were both impressed by Kiss The Baby Sky, it’s a wonderful song, so touching.

Absolutely great 5 and only people.

No matter in recording room or on stage, wherever they are, they just own it. Even I got my strength from them.

All fans were so worried about JUNSU. However, the injury on his leg is getting better now. Junsu himself laughed and said aloud, “It’s all because your support!!!”

They never forget to thank fans for the support they have. For me, this is one of Tohoshinki’s charisma.

In July, they’ll release a new single, everyone please anticipate it!

Thank you for bringing such wonderful 3 hours.

ZOOM IN SUPER will always support Tohoshinki.

The shooting of PV was shot in the suburbs of Kanto.

From early in the morning, we already started shooting.

It was a very good weather outside.

The Battle of Pop - Asia vs Asia is finally over. It created a bit of drama since the setup for it wasn't the best. In my (Kousei, Ayame a.k.a. Raven) opinion they shouldn't have made Big Bang and Tohoshinki go at it from the start, that was just a drama match waiting to happen. Most of the drama started once Big Bang lost and Tohoshinki had to go up against Super Junior. V.I.P. (Big Bang's official fan-club) were upset that they (Big Bang) lost, so they teamed up with E.L.F. (Super Junior's official fan-club) when Super Junior went against Tohoshinki. (Not sure if it's actually true that they teamed up, that might be a rumor, but judging from the gap, it might be true.)
Tohoshinki DID make it to the third round though, so congratulations to them.

What It's About
DBSK fans become penpals with children in hospitals/orphanages. Spread the love by reaching out to people all over the world.

The Letters
1. We contact other fansites/forums.
2. Fans will submit their name and country to us.
3. We (AOE) compile the fan list and find hospitals/nursing homes/orphanages that have possible penpals.
4. We send each fan the address and name of their fellow penpal.
5. Fans purchase a red envelope (and small, flat gifts if they want)
6. Fans write a letter, sign it at the very end as, "__(NAME)___, a DBSK fan".
7. Fans send it (postage stamps and all) to their penpal.

Donations
1. We either ask for donations on a site, or redirect them HERE onto AOE (as is the case for Soompi Forums).
2. We collect as much as we can, and send the donations to WFP in the name of DBSK.

[News] DBSK and Big Bang to Attend Video Music Awards Japan 2009

Korea’s biggest idol groups Dong Bang Shin Ki and Big Bang will be attending one of Japan’s biggest music awards ceremony.

They will be attending ‘Video Music Awards Japan (VMAJ) 2009 on 30th May in Japan Saitama Super Arena.

‘VMAJ’ is one of Japan’s biggest music awards that not only awards Japanese local singers but also international singers. Even world-known pop stars like Michael Jackson, Mariah Carey and Ne-Yo had received invitations to the award ceremony.

Group Dong Bang Shin Ki, who is currently active in Japan, is nominated for ‘Best Group Video’ with their hit song ‘MIROTIC’, up against 4 other Japanese teams including EXILE .

Group Big Bang has also be invited to attend the award ceremony. YG Entertainment announced on the 15th that chances that Big Bang will attend the awards ceremony are high. And they will also probably be having a performance slot during the award ceremony.

Already on the 15th, Big Bang’s photo have been posted up together with other stars like WWE star Big Show on VMAJ 2009 official site.

JJ: Hahaha. That’s very detailed questionnaire *laughs* I grew. About 1cm since debut. Although I don’t think I can grow taller anymore. Oh, and I grew heavier about a month ago so I started training again and my muscles started getting bigger. But because Japanese staff and fans said they don’t like a muscular Jaejoong, so I stopped training so vigorously.

The new album, The Secret Code is a smash hit! Has a really good quality content, the image is showing their growth after the condensed 4 years.

[JEJUNG] In the process of recording the album, I had this growing awareness which particularly I never felt. But then after it’s completed, I do feel the growth of us. How we sang when we just debuted was just not as mature as how we do now.

[YUNHO] I’m glad to get through the recording safe. When I first came to Japan, I was really anxious, too aware of Japanese pronunciation, it was hard just to get what’s the meaning. But recently I’ve also improved a little Japanese, without worrying about the pronunciation, I was able to put feelings into songs. Even when we have lack of time to do recording, thus we tried to listen to the songs by ourselves, Oh, then I just can feel the soul now and I can understand the lyrics to the point it develops to higher point of understanding.

[CHANGMIN] Actually, when the time had come to go back and forth between Japan and South Korea for recording the album, I didn’t believe we could afford the time to do all of them at all. But even in that situation, as YUNHO said, I was able to sing with emotion. I could feel the growth there, I am very happy.

[JUNSU] The width of the songs is spreading. There are a variety of genres which I think only because it’s TVXQ therefore it’s possible (to be sung by him). To be able to make such album, by thinking that, it is delightful, and I think my confidence increases.

- YUCHON JEJUNG, Ones who record your own lyrics and self composed songs. What is the image of your self composed song?

[JEJUNG] “Wasurenaide” and the ballad “9095″. I composed a song called “Wasurenaide”, it is a song which I originally made to be sung in Japanese . So I wrote my own lyrics in Japanese. But it is very difficult (laughs). Conversely, “9095″, rather than made by a thought, it just came out really fast from my mind. I was composing at home in my leisure time, and suddenly it’s just popped out. “I want to compose a song like this!” that’s what I thought. And I am happy to have it inserted in the album. When I first came to Japan, I did not think I would write a song in Japanese. I do not believe it myself, but I think that’s the part of the growth

[YUCHON] “Kiss The Baby Sky” is a song which has been composed by having pictures in my mind that all of us will sing it together on tour. The content of the lyrics is an image of two lovers bid farewell with a smile. They split up for the future of each other. A sad yet positive song. When the tour comes, I want to sing along with the audiences.

[CHANGMIN] This is an album where I think I was able to express TVXQ in a lot of ways, it’s because I’m with you guys, I have more growth. If it’s possible, I look forward to a future where we’ll still enjoy time together, doing what we can do together.

- Yes, we hope so too. So everyone, finally on April 22th in Sunday’s new single, “Share The World / WE ARE!”. Both of the songs are used in anime ONE PIECE, right?

[YUNHO] As all of TVXQ members are happening to love ONE PIECE and due to the fact that it’s even aired in Korea. Therefore, being able take charge of the opening theme 2 times in a row, it is an enormous happiness. And as a bonus track, the ending theme of ONE PIECE in 2006, “Asu wa Kuru Kara” is also included. So this single is indeed a ONE PIECE single. So not only TVXQ fans, I think ONE PIECE’s fans can also enjoy it.

[JEJUNG] “Share The World” is a song with summer-like atmosphere, and really suits to the next season of ONE PIECE. We also will have anime PV of this song which is not seen yet, I feel is, I’m psyched. However, it’s so hard to watch ONE PIECE in its April season due to its early-morning air time, TVXQ is a little weak in the morning (laughs). I think it’s hard to get up early, but we’ll try.

Special date-
I don't usually do this ^^ Maybe when she's not aware of anything i'll prepare a surprise, and that's cooking. Maybe she can't imagine what dishes i'll make. Last time on a Japanese program I cooked but I wasn't successful (laughs).

Menu is: Because my dad's a manager for a pizza shop in Korea, making a pizza shouldn't be a problem.
A heart shaped pizza ^^ Ah, it's so hard!! (laughs) But bringing a heart shaped pizza must be very surprising ^^ After arriving we can eat the pizza while watching DVD, just relax spending a day like this.

Ah, so this is a special date ^^ It's quite a normal day after all ^^ However it's the most comfortable day~ If it's an outing, I really wanna go to the seaside because i like places with crowded atmosphere and it's by the sea. In the evening we can play at the shore and when it's night, we can go to a place with beautiful scenery. Because of work i went there before and rode on a sightseeing coach. The night scenery was absolutely beautiful~

In the still of the night staring at such breath-taking scenery and with this romantic aura, sitting beside me was my manager and at instant reality came back.

Oh yea, couple shirts!! There are a lot of people wearing couple shirts in Korea ^^ Just two people wearing it feels very goof. Of course showing off like this in front of everone is embarrassing but it's just stating two people's steady relationship and how loving they are. I always have a feeling like this, I think this is a very nice thought, confirm!

She and i will wear couple shirts and go to the shore and ride on a sightseeing coach!! Although it's very eye catching but if can, I will quietly write "Good!"**

YAMAHA NOUVO ELEGANCE

[30th March 2009 - 18.30 - Bitec Bangna] Dong Bang Shin Ki (TVXQ!) members Xiah Junsu, Micky Yoochun, Youngwoong Jaejoong, Choikang Changmin and U-Know Yunho have flown all the way to Thailand as presenters of YAMAHA NOUVO ELEGANCE motorcycle at the Bangkok International Motor Show 2009. Loads of fans (Cassiopeias) welcomed and cheered for them.

Fans have been coming to the YAMAHA MOTOR booth to wait for TVXQ! since morning. Once TVXQ! arrived on stage the fans cheered very loudly for a very long time!

As soon as the interview started, the MCs asked right away "Have you heard of Bangkok International Motor Show before?" To this Yunho replied "First of all, we'd like to greet the Thai fans 'Sawasdee krub, Dong Bang Shin Ki krub'. To answer your question, we've heard that this is an annual event for all kinds of vehicles. We feel honored to be part of this event."

In addition the BIKE OF THE YEAR 2009 Award goes to YAMAHA NOUVO ELEGANCE 135. Changmin reveals "I'm glad and proud that YAMAHA NOUVO ELEGANCE won the award. We weren't expecting this and we're happy to be part of it's success."

Junsu mentions about TVXQ!'s current activities "As you all know, right now we have activities in Japan and we're preparing for our live tour there. We'll have our (Asian) tour concert in Thailand soon. Please look forward to it." Yunho added "In future, if we have the chance, we'll try to visit Thailand as often as we can."

"You guys have so much to do! Do you get any rest?" JaeJoong promptly replied "Actually we do have breaks. We meet our friends, listen to music, greet our fans in websites." When asked which tourist attraction he wants to visit, Jaejoong says "I want to go to Chiangmai!" And fans cheered loudly again!

The highlight of this interview is the five members' speaking Thai phrases. Junsu's "Xiah Junsu jud hai!" (Xiah Junsu made it for you! / Xiah Junsu provided it!), Yoochun's "Ngan khao!" (literally means "Incoming work!", basically means "Gonna be (kept) busy!"), Jaejoong's "Micky Yoochun pe mak!" (Micky Yuchun's right on target!), Changmin's "Nae-non yoo laew!" (That's for sure! / Of course!) and Yunho's "Nuovo Elegance doan! Doan sud sud laew! Doan!" (I love Nuovo Elegance! 'doan' literally means touch, hit, strike, bump against - in this case 'touch (my heart)'). All those phrases certainly raised the fans' blood pressure!

Before leaving, they also have a few words for Thai fans. Junsu said "We returned one month after SMTOWN concert and the fans received us with so much warmth. Thank you to all fans. We're extremely happy." Yoochun added "We're also very happy to be this close to our Thai fans. We'll have a (mini) fansigning event after this, lets make good memories and hope we'll always be like this." Jaejoong said "We have visited Thailand a few times. We'll try to come more often. And I haven't had my elephant ride - I'd really love to do that!" As for magnae Changmin "Thai fans receive us with so much love! We'll try to come more often and thank you for all the support you've given us." Finally leadershi Yunho's turn "Thailand is a charming country. Whenever we come we fall for our lovely and kind fans' charms. As for the concert, it won't be that long a wait!"

After the interview, TVXQ! held a fansigning event for over 50 lucky fans, happily and enthusiastically. The fans who attended the day's event all returned home with smiles on their faces.

Note: Chiangmai is one of Thailand's well-known tourist attraction. It's one of the northern provinces that have elephant centers.

[News] TVXQ in Hollywood Movie OST

5 male members group Dong Bang Shin Ki’s Rising Sun was insterted in the song list of United States’ Blockbuster Movies “Fast and Furious”.

Rising Sun was registered in the site of “Fast & Furious (2009)”, while the singer Dong Bang Shin Ki was introduced as TVXQ, taken from its Chinese pronunciation “Tong Vfang Xien Qi”.

“Fast and Furious: The Original” is scheduled to be released world wide on April 2nd, wherein Rising Sun becomes the background music in the characters’ chasing scene.

Rising Sun is a work by composer Yoo Young Jin and was one of the tracks in Dong Bang Shin Ki’s 2nd album with the same title “Rising Sun” released in September 2005.

Tohoshinki’s First Week Sales Record

Popular group Tohoshinki finally cracked the highest sales record ever since their career in Japan. Tohoshinki’s 4th album launched on March 25th, “The Secret Code” recorded first day sales 82,891 copies, and the next day on March 26th was sold 30,620 copies, thus the accumulation in 2 days straight is around 11,000 copies, placing them on the 2nd in ORICON album chart.

Tohoshinki made their highest first week sales record which is definitely their best result so far.

Meanwhile, Ayumi Hamasaki’s new album “NEXT LEVEL” was sold for 48,318 in the 26th, placed her on 1st in two consecutive days in ORICON album chart.

The original set date 3rd April at 5pm at Nanjing Xuanwu Hotel to hold "TVXQ! 3rd Asia Tour Concert - Nanjing, China" press conference was confirmed cancelled due to TVXQ's transfer flights on that day. Really thankful to all the media's (reporters) attention and support towards TVXQ's concert!

This morning, the organizers received SM's notification explaining due to TVXQ's flight on 3 April delayed for some reasons, the time arriving at Nanjing would be adjourn so as to ensure that day's rehearsal, SM worries there's no time to reschedule the interview because it'll cause inconvenience to both foreign and China's reporters. Hence, the press conference is cancelled. This is a formal notification in advance, the organizers are deeply sorry about this.

Dong Bang Shin Ki on March 22nd, were spotted attending a preparation for fashion model “The 8th Japan from Tokyo Fashion Week (JFW)“ that will be held on March 23rd in Tokyo sponsored by Sports Hochi and Nippon TV, under AVEX group.

Being all dressed in black costumes, TVXQ members demonstrated their skills in walking gracefully on catwalk and audiences who filled the venue were so pleased to see them.

Not only modelling, TVXQ also sang one of the songs from their March 25th-released album “The Secret Code” and also becomes main theme of Subaru the movie, “Bolero”.

To the audiences of the show, TVXQ leader U-Know Yunho said, “Ever since it’s our first challenge in fashion model, we’re so nervous.” and his fellow member Choikang Changmin added, “As for our album, you can feel the more mature feeling of Dong Bang Shin Ki.” he stated, in confidence.
